Research On Rural Community Administration From The Point Of View Of Administrative Law

Over the years, under the influence of urban-rural dual system structure, cities and countryside have been split into two independent and isolated administrative units. The cities have a high degree of rule of law with advanced and flexible governance, while the countryside's level of rule of law is low with the old rigid form of governance. It is urgent for us to confront the current situation and explore ways to enhance the degree of rule of law in rural areas' governance which is an important part of the legal construction in China. This paper plans to start from the new form of grassroots governance in rural communities, analyzing the development of the grassroots government power and the villager selfgovernment rights as well as their interaction, exploring ways to consolidate the legal authority at the grassroots level governance, and standardize administrative power operated in rural society,. Through analysis of the form, the procedure and the substantive dimension of community governance mechanisms, the author tries to establish a rural management mode which is guided by the party committees and governments of villages and towns, dominated by the villager autonomous organizations, and jointly participated by other diverse subjects.The first part of the article is raises questions, introduces the purpose and significance of the research, and reviews current research status of rural communities governance at home and abroad. The second part mainly analysis the content of the problem, which is based on the pilot community governance mode and the rule of law practice of investigation, analysis of the category of governance, decision-making process, the running status of agency relation and legal system, to explore the basic unit government administrative power and the function of community autonomy organization exercise between the confusion and conflict, cross and conflict. This part mainly analyses the rural community governance in accordance with the existing difficulties and problems, and then introduced the new type of governance of the rural community unit and related governance theory. The third part exerts its efforts to solve problems, focusing on system design, extending new constructive ideas by comparing the existing research results. The ideas are how to further improve the construction of the rule of law in rural communities and its governance systems, how to promote the construction the rule of law in rural communities, and how optimize community governance model, so as to follow the development trend of administrative rule of law.With the changing times, the traditional administration which characterized as mandatory orders are gradually evolve to random guidance. The basis of administrative power functioning in rural society is no longer management, but evolves to service and organization. It is an important part of rural community governance under the Vision of Administrative Law that we figure out how to strengthen and improve the level of grass-roots government's administrative services, organize each governing subject in rural communities to actively participate in multiple governing system and its governing process, as well as share the results of it.
