In recent years, due to the rise of green consciousness, green consumer market has made great progress. However, some operators do not hesitate to use all kinds of means to carry on the green marketing for great profits, which seriously infringed on the rights and interests of consumers. In the world, there are full of a large number of green marketing phenomena, which make the relevant laws and regulations to regulate them, and Chinese relevant laws and regulations are not very perfect. In view of this, the thesis discusses from the perspective of the protection of consumer rights and interests of greenwash marketing research in order to improve the legal regulation of Chinese greenwash marketing countermeasures.Firstly, after consulting on the basis of a large number of domestic and foreign literature and case, the thesis focus on green marketing with detailed analysis and research of their concept and specific behaviors, combined with the existence of a large number of greenwash marketing phenomenon, the study summarizes the damage of consumers' rights and interests caused by the greenwash marketing. Secondly, by comparing the domestic and foreign relevant laws and regulations of the analysis, it summed up the foreign green marketing regulatory advantages, such as some green marketing of special provisions, and the intellectual property system also formed a good regulation of greenwash marketing.Some of laws and regulations of our country play an important role in the regulation of the green marketing, but the defect is obvious. Especially in the 2.0 era of greenwashing,current laws and regulations are not enough to deal with the existence of new problems.Finally, based on the current situation of Chinese greenwash marketing, it analyzes specific laws and regulations and the relevant provisions of the proposed recommendations in addition to the suggestions which are put forward from the macroscopic angle to regulate the false propaganda and commercial signs under the Anti Unfair Competition Law, Trademark Law, Advertisement Law, Consumer protection Lawand other some suggestions. As a result, the thesis hopes that the interests of consumers due to the loss of green marketing can be damaged after such as return, green insurance,litigation and other effective relief.
