The third plenary session of the eighteenth made it clear that the collective management of rural construction land can be sold,leased,and taken shares under regulation in conformity with the relevant planning and the land can also be established as a unified construction land market.The state-owned land and rural collective management of construction sites must be implemented following the same market and the same right to the same price policy.With the rapid growth of industrialization and urbanization,due to the irrational allocation of land resource elements,"Land shortage" problem becomes more prominent,we must resolve the conflicts between "land shortage" problems and inefficient use of collective construction land.This paper aims to explore the difficulties faced by the research under the background of the circulation of the right to use the collective construction land so as to find a feasible way.This paper adopts the literature research,case analysis and inductive research method,with the background of the circulation of the right to use the collective construction land combined with local practice cases study,we propose to improve the way of the circulation of the right to use the collective construction land.This paper is divided into four parts:The first part is an introduction,introduces the background and significance,research status,related concepts and theoretical basis,research ideas,methods and innovations.The second part is to explore the circulation of the right to use the collective construction land place in order to identify the issues presented by the pilot through the introduction of the circulation of the right to use the collective construction land background and place practices.The third part describes the operating rural collective construction land use right transfer problems and causes.Due to the presence of agricultural land transfer lack of legal regulations and institutions,the rural collective management of construction land transfer mechanism is not perfect and rural collective management of construction land use right transfer real factors with the existing land requisition system conflicts,leading to rural collective management of construction land use right transfer facing difficulties.The main causes of these problems is the collective land ownership dummy restricting rural construction land,there is a conflict of interest between the government and the collective farmers,government departments lack of effective management of the transfer of agricultural land and transfer income distribution relations and unreasonable.The fourth part is to recommend some suggestions about improving the circulation of the right to use the collective construction land.By modifying existing relevant laws and regulations about the agricultural land transfer,we may strengthen the construction of rural land circulation system and improve the circulation of agricultural land market trading system in order to explore a feasible way to improve the land value-added income distribution mechanism for the realization of rural collective construction land.
