The Study Of Improvement Of Civil Service System In China

The system of service is as a linkage of the civil procedure law in our country. It is like a bridge which contact the process server and the party. So to speak that any stage of the proceedings,if not served to participate effectively,there may be faulty,and will exist flaw procedure, which is also the fundamental requirement of the proceedings. With the continuous evolution of modern science and technology, the way people served between each other also developed with each passing day. However, examining the civil service system in our country is still stick in the mud. Unsound legislative process is the cause to the deficiency of both the legislative procedure and the judicial practice. The problems of service has became a huge obstacle to hinder the people's court to improve the trial quality. In practice, the service practice which have broke through legal system appeared constantly, the system of civil service legislation has obviously not conformed to the actual requirements.Aiming at the problems of service, there are many theories and views existing in academic circle, yet with little satisfactory or feasible improving methods. For the civil service system of our country, we need joint effort from all sectors of society to ensure the more permitting and scientific processes. First, we need to make an accurate definition of civil service system of our country. Making sure the service system is in the equal status, such as property preservation system. The second, it is to establish the lawsuit idea, nothing but this concept has been a consistent embodied in legal principles and specific rules, and can ensure the realization of the procedural interest. On this basis,conceiving the method of improvement of civil service system. First of all, to change the single service subject. Establishing the service system which is combining inquisitorial system and adversary system. And then, to explore the socialized mode of civil service system. The second, to renew the traditional ways of service. Such as using comprehensive service methods, strengthen the status of the electronic service etc. The third, to refine the application of the service methods further. Respectively refining the seven ways of service system. The fourth, to refine the rules of responsibility of the service system. Clearing the obligation of informing relating to the personal information of the parties or the punishment measures of interfering the service. The last, to make sure the problems of payment and delivery. In this paper, through the studies of the legislative development and current situation of the civil service system in our county,comparing with the developed experience of foreign legal system, transforming into viable strategy which can be used in our country, to contribute to the modernization of China's civil service system. At last,summarizing the deficiencies and problems of China's civil service system,and trying to put forward the corresponding suggestion,then discussing the solution of how to solve the problems of civil service system.
