The Operational Dilemma And Outlet Of The Civil Service System

In civil litigation,the service system is not only the link between the litigation actions before and after,but also the bridge between the parties and the courts to communicate information.However,in the judicial practice of civil litigation,the difficulty of service has become an important problem that troubles the courts and affects the fairness and efficiency of civil litigation trials.Although the academic circles have paid attention to and studied it,and the Supreme People's Court has made judicial explanations for it,it has not fundamentally solved the problem of the difficulty of service.Based on judicial practice and through theoretical and practical analysis,this paper investigates and combs the operation status of civil service system,reveals the outstanding problems existing in our current civil service system,and provides some useful ideas for the improvement of our civil service system,with a view to achieving the value unity of judicial justice and trial efficiency.Combining with judicial practice,this paper combs the existing problems of the seven modes of service,reveals the dilemma of the operation of the civil litigation system in China,and puts forward the improvement path according to the various problems existing in the dilemma of the operation of the civil service system.First,from the legal system level.On the basis of reorganizing and perfecting the traditional service mode,we should construct a service mode with court service as the main part and party service as the supplement,and gradually change the current service mode of authority doctrine in our country.At the same time,conform to the development of economic and social informationization,and strive to improve the way of electronic service.In addition,targeted punishment measures are put forward for evading service.Secondly,combined with the working practice of the transcript,the author gives some suggestions on how to solve the operational dilemma of the civil litigation system from the aspects of perfecting the service management system and service mechanism within the court.Finally,from the aspects of perfecting population information management,establishing grass-roots assistant service network,perfecting diversified dispute resolution mechanism and increasing financial support,the corresponding measures to solve the dilemma of civil litigation system are put forward.
