Real estate regulation and control affect the life of many families,for the 2016 Shanghai and Shenzhen real estate market regulation of the situation,from the point of view of administrative law,it is helpful to deepen the understanding of this field and find the problems and shortcomings in the Shanghai and Shenzhen real estate regulation and control policies.Through the thinking of the administrative law of the Shanghai and Shenzhen control policies,it also helps to spread the concept of governing the country according to law,carry forward the authority of the rule of law and promote the development of China’s governance structure and governance to the modernization of the rule of law.The first chapter introduces the reasons for the introduction of Shanghai and Shenzhen real estate regulation and control documents,and then analyzes the main contents.The second chapter,combined with the basic theory of administrative law of the relevant knowledge of the contents of the control policy specific analysis of the Shanghai and Shenzhen real estate regulation and control of certain policy measures there are illegal and unreasonable problems.Contrary to the principle of equality,proportionality principle and trust protection principle.Shanghai and Shenzhen municipal government did not implement the basic principles of administrative law into the actual administrative activities.The third chapter introduces the real estate control measures of Singapore,Britain and the United States,and finds out that the real estate regulation and control of the developed countries should focus on the legalization of the control policies.On the other hand,the real estate market tax and credit means more balanced and.reasonable,can learn from.The fourth chapter discusses the necessity of legalization of real estate regulation in Shanghai and Shenzhen.Finally,in view of the problems existing in the regulation of the real estate market in Shanghai and Shenzhen two cities,some suggestions are put forward.First of all,the specific measures of regulation and control of the rule of law include:local People’sCongress legislative regulation,administrative reconsideration,administrative litigation,administrative procedures,hearing system,etc..Secondly,in the specific means of regulation and control,adjust its rationality.By optimizing the use of land policy and weakening the difference between household registration,and gradually reduce the restriction on the purchase of credit policy and other ways to protect the rationality.Finally,in the context of the real estate regulation and control system,put forward to strengthen the central guidance and supervision to promote the Shanghai and Shenzhen control policy more legitimate and reasonable recommendations.
