Research On Power Restriction Mechanism Under New Media Background

New Media technology has experienced fast growth these years.New media plays an important role in supervising national public power and judicial process,which has become a new shining point in innovation of Chinese power supervision mechanism.However,since new media power supervision is built on virtual space,fake reports or irresponsible opinions appear frequently,as a result,there is misplacement of new media supervision.From foreign related regulations,United States,England and European Union have tried to take advantage of journalism law,Internet law and self-supervision to correct the problems of new media power supervision.This essay attempts to analyze the related cases in 2015,summarizes the new media power mechanism and existing problems,and makes use of comparison methodology to learn experiences from mature legal regulation.Lastly,this essay wants to put forward some useful suggestions.This essay consists of introduction and four chapters.The first chapter analyzes the theoretical issues regarding new media,including the concept,characters of new media and the nature of new media supervision.It has characteristics of interaction,over-timelineness,the main particularity of the subjective and diversity of targets.The second chapter puts forward the positive influences of new media power supervision and existing problems.New media supervision has an effective impact on regulating political profit-seeking,promoting power publicity and adjusting justice fairness.However,it also has the problems of insecure information foundation,subject's biased standpoints and mass media trial.The third chapter analyzes the experiences of other advanced countries regarding regulating new media power supervision.It adopts the comparison methodology to study the practices of advanced countries,learn lessons from their measures.The fourth chapter summarizes current legal framework about new media supervision,build on the problems of Chinese new media supervision to put forward some useful suggestions.These measures involve formulating the regulations and new media communication,building Self-Regulatory System,strengthen Internet law,improving transparency of government affairs and improving the disciplines about self-media.
