Research On Legal System Of Internal Reporting Of Food Safety

Food safety is the root of the people, food safety issues related to all aspects of social life. Now the society, food safety problems are common, a variety of food safety problems,as we sounded the alarm. Food safety as a special area,with a wide range of effects, the consequences of serious and so on, it is necessary to strengthen food safety supervision. In order to solve the problems in food safety supervision, it is necessary to strengthen the research on food safety supervision system. To improve China's food safety supervision mechanism, we can not rely solely on limited government regulators,but need to play the power of the public, by mobilizing the public's supervision and enthusiasm to expand the intensity and depth of supervision. In the public supervision team,the food safety internal informants have a dominant position, the internal informants can more clearly understand the food safety industry problems, the timely detection of food safety violations,to avoid food safety issues Appear to be of great significance.This paper mainly studies the legal system of food safety internal reporting, first introduced the basic theory of food safety internal reporting legal system. Through the understanding of the concept of legal system, legal attribute, legal basis and meaning of food safety internal reporting, it is an initial understanding of the legal system of food safety internal reporting. The so-called food safety internal reporting legal system is the person familiar with food safety issues. Known "insider" to the food safety regulatory authorities to report, the relevant departments to give the appropriate incentives and provide a comprehensive protection system. This system has the same meaning as the "whistle" system. Therefore,this article through the introduction of the United States, Britain, Japan on the "whistle" of the relevant system, learn from abroad for the "whistle" system of the basic system, reward system, protection measures, relief procedures related to further improve our food Security internal reporting legal system.By studying the legal situation of foreign "whistle" system and the internal reporting system of food safety in China, including the legislation, practice and effect of food safety internal reporting system, we find that there are problems in the legal system of food safety internal reporting, including internal Reporting the basic system is lacking,the incentive system is not perfect,there are still inadequate protection measures,relief procedures are not smooth four aspects. Finally, this paper puts forward four suggestions for perfecting the problems existing in the legal system of food safety in China, including improving the basic system of internal report on food safety,improving the reward system, strengthening the protection system and improving the relief mechanism. This paper argues that the real decision whether the internal whistleblower is to provide information is the key to the government to provide effective protection, and incentive measures can only be used as one of the incentives,the focus of this system is the protection of internal informants. For the internal whistleblower to provide consistent throughout the effective protection measures for the internal reporting of people to report to solve the worries, and truly play a food safety internal reporting system of great significance.
