The Research On Legal Prevention And Control Mechanism Of Food Safety Risk

Food safety is not only about the health and life safety of people but also the overall economic and social development.In other words,it has great impact on China's participation in international competition,the benign development of domestic economy,improvement of people's livelihood and maintenance of social harmony and stability.Currently,food safety and food safety risk prevention and control are major problems all countries are trying to solve.This paper,by combining with important aspects of food safety risk prevention and control in legal level as well as practices of developed countries,has made a comprehensive analysis of problems existing in China's food safety risk legal prevention and control and corresponding strategies from five perspectives: fundamental theory of food safety risk prevention and control in legal level,text analysis of China's food safety risk legal prevention and control mechanism,food safety risk legal prevention and control mechanism in comparison method and China's reform path on food safety risk legal prevention and control mechanism.First,the first part of this paper has introduced the research background,significance of the subject and research states at home and abroad.Upon that,research methods are put forward.After that,the second part defines relevant concepts on food safety,introduces the theoretical foundation of food safety risk legal prevention and control from law-based administration theory,risk control theory and social governance theory and illustrates the necessity of food safety risk prevention and control in legal level.Second,the third part states and analyzes the legislation status quo of risk prevention and control by tracing back the development history of China's food safety risk legal prevention and control mechanism.In this part,problems existing in China's food safety risk legal prevention and control mechanism are examined and existing defects in legislation are summarized from risk assessment,risk communication,risk pre-warning,risk disposition and risk rehabilitation.Third,the operation state of food safety risk legal prevention and control mechanism in practice is an important and unavoidable problem for studying food safety risk legal prevention and control.In the fourth part,the status quo of China food safety risk prevention and control is commented by basing on relevant statistical data through field interview andquestionnaire survey.Meanwhile,collected typical food safety events are used to make an in-depth analysis of the effect of food safety risk prevention and control mechanism.The fifth part of this paper makes a detailed introduction to practices and features of developed countries regarding food safety risk legal prevention and control mechanism with a view to providing important reference for China's food safety risk legal prevention and control mechanism.The sixth part of this paper is based on above analysis when basing of the concept of complete prevention and control to put forward reform measures for completing China's food safety risk legal prevention and control mechanism and designing corresponding supporting measures.The final part of this paper is the conclusion which points out that China should constantly complete its food safety regulation system to make sure that there are laws to follow for every part of food safety,such as supervision,prevention and emergency handling.
