Study On Legal Issues Of Social Responsibility Of Corporate Food Safety

"To the nation citizen is all-important, to the citizen foodstuff is all-important, to the foodstuff safety is all-important",so since ancient times,food safety is not only closely related to the health of the citizen, but also has direct influences on the social harmony and stability and the sound development of the country. In recent years,Henan Jiyuan Shuanghui company uses "Clenbuterol" pork, Shenglu Food Co., Ltd. branch company producing "dyeing steamed bread",Tianjin and other places processing "waste oil",Ajisen (China) Holdings Limited company using with "flavoring of pork bone soup"and other major incidents on food safety occur frequently, to which the government and other authorities attach great importance, and scholars from different fields conduct in-depth study on it. As the first person of the social responsibility of food safety, the chief subject of this paper is to probe how to carry out food safety's social responsibilities of Company (hereafter referred to as "FSSRE")in our country through the literature reference method, the normative research pattern, the active analysis pattern and the comparative research pattern, on the basis of the theory of food Corporate social responsibilities. Food company, social responsibilities, to protect food safety,safeguarding the legitimate rights and interests of consumers to find a path.This paper is divided into the following three sections:In the first section, the concept, properties and desirability of FSSRE are discussed. This section analyzes the concept of FSSRE and defines the purpose of the study of this paper as food production corporate. The characteristics of its social responsibilities include: the core of FSSRE is to ensure food safety, the Corporate is the first person for social responsibility of food safety, the connotation of FSSRE has extended. And then the necessities of FSSRE are found to include the followings: stake-asserting of all the legitimate rights and interests of the food customers, and enhancement of the competition in food corporate, maintenance of public order and tranquility, and improvement of food safety system.The second section,talks about the current circumstances of the FSSRE in our country,analyzes the existing problems of the FSSRE in our country, including the inefficient practice of HACCP system in food corporate, the imperfect self-discipline mechanism of food industry, the insufficient of company social responsibilities of information disclosure reports, the imperfect of file system of Company food safety credit.The fourth section, studies legal questions about how to perfect FSSRE in our country.Firstly, with a view of perfecting the practice mechanism of social responsibilities for food safety within company, to enhance the practice of HACCP system. Secondly,enhance the self-discipline of the food industry. Thirdly, strengthen the external audit to improve company social responsibilities of reporting the food safety information.Finally, improve Credit file system of food safety.
