Study On Legal Issues Of Chinese Rural Land Rights' Registration And Certification Work

From central file N0.1 2008 for the first time officially proposed to “Accelerate the establishment of land contract management right registration system”,to central file N0.1 in the past five years repeated multiple times,the issue of land tenure about the vital interests of farmers has become one of the most important priorities of the central government.The registration work of the rural land contractual management right,no doubt would become the priority point of view when study in rural areas.Coinciding with the fact that zhangjiajie city,Hunan province,as the hometown of the writer,is one of the new pilot areas of the registration work of the rural land contractual management right,this article selected the registration work in zhangjiajie city,Hunan province as the practical support,hoping to know and understand things from the small pilot area,analyses on the legal problems that may be involved in the registration of rural land contracting right,refining the experience and lessons of carried out in the pre-pilot areas,through field investigation and data analysis on the newly added region in yongding district,zhangjiajie city,Hunan province,to discover the problems and try to put forward the corresponding countermeasures,knowing the possible common problems in China's process of registration work of the rural land contractual management right,so that to provide some references and inspirations for the improvement and perfection of the registration work in other areas.This article is divided into six chapters.The first chapter presented the research background,research significance,research status at home and abroad and the research content and methods of the registration work of the rural land contractual management right.The second chapter is an overview of registration work in our China,defined the basic concept and basic theory involved in the registration of rural land contracting right.The third chapter briefly introduced the legislation and practice of the registration work.The fourth chapter,through combining the actual situation of yongding district,zhangjiajie city,Hunan province,introduced the overview of registration work of the rural land contractual management right,analyzed the work content as well as solutions to specific situations.The fifth chapter analyzed the reasons which led to the issues discovered during the process of work and try to put forward some recommendations.The sixth chapter is the conclusion of the whole paper.This whole paper concluded that we China should perfect the relevant legislation on the registration of rural land contracting right,clarify the legitimate rights and interests of farmers,establish strict approval registration publicity system,perfect the verification organization,refine counterpoising work,strengthen the approval procedures,establish and improve the registration relief mechanism,take strict enforcement,so that to promote the registration work of the rural land contractual management right.
