Study On The Legal Issues Of International Financial Mechanism For Climate Change

The Paris Agreement which was passed in 2015 brought the issue of climate change into the public view.The issue of climate change can be attributed to four major problem,the financial problem is the foundation for other three problems'(i.e.mitigation problem,adaptation problem and technology transfer)solution,and it has always been a key and difficult problem for international community to deal with the issue of climate change.The Paris Agreement,as a third document which has legally binding force in climate change,has brought a new development for international financial mechanism for climate change(hereinafter referred to as financial mechanism).The international community has called the new era of international climate cooperation which began after the Paris Agreement in operation as “the post Paris era”.In the post Paris era,what kind of trends and problems will the financial mechanism have? How will China seize the opportunity and prepare for challenge according to the operation of financial mechanism? This thesis aims to solve these two problems.United Nations Framework Convention on Climate Change(hereinafter referred to as UNFCCC)arose as the first international legal document in climate change,and it is the international legal basis for the international community to cope with climate change.Therefore,the study of the financial mechanism should be carried out under the guidance of the provisions and principles which are stipulated by UNFCCC.Because the Paris Agreement will take effect in 2020,this thesis uses the method of historical analysis and comparative analysis.This thesis studied on the legal definition and fundamental principle of financial mechanism which is stipulated in UNFCCC.Based on that,thesis analyzed the regulations of financial mechanism from three aspects(financial raising,management and using).Meanwhile,thesis compared the regulations with the new regulations in the Paris Agreement.In conclusion,the study found that the financial mechanism presents a development trend that it runs independently.China should actively participate in international climate governance and enact laws which relate with the issue of climate change on financial aspect.The lack of research on the Paris Agreement brought some obstacles for this study.However,that is also the innovation of it.
