Research On The Single Window System Of China Pilot Free Trade Zone

Since the first trade management integrated electronic customs clearance system in Singapore was activated,the enterprise through a single window to achieve trade facilitation quickly become the mode.More and more countries and regions organization respected the "single window" concept.In the process of promoting trade facilitation,all countries in the world have integrated the basic elements of trade facilitation,that is,simplification,coordination and standardization,and make full use of modern information technology,communication technology,computer technology and standardization theory to form international trade Single window system.At present,for many countries,as a trade facilitation application,the single window of international trade has become a central means of promoting trade facilitation and simplifying of trade procedures.The single window system of international trade has been sprung up in the world,especially in developing countries and transition economies.September 29,2013,China(Shanghai)Pilot Free Trade Zone was formally established,April 21,2015,Guangzhou,Tianjin,Fujian Pilot Free Trade Zone have set up.June 6,2014,the first pilot project of International Trade single window of Shanghai Pilot Free Trade Zone began to operate.At present,the International Trade single window of Shanghai Pilot Free Trade Zone has been upgraded from version 1.0 to version 3.0.In just a year,Tianjin,Fujian,Guangdong three Pilot Free Trade Zone,made different progress in the construction of a single window system of international trade.The four major FTZ are achieved in varying degrees in the data channel between General Administration of Customs and AQSIQ,and documents paperless;customs and and quarantine departments join hands in information exchanging,mutual recognition of supervision,law enforcement and other mutual assistance.But we should notice the weakness at the same time,we should see that there is still considerable room for improvement of the current China Pilot Free Trade Zone in the implementation of a single window system of international trade.Here is the example: in the operating and charging system of single window,the port regulatory authorities may have the problem of responsibility allocating,some government departments are still put more emphasis on regulatory than services;in the problem of international trade single window data sharing and protection regime,there are still cases that the use of standardized data is inefficient,the protection of trade data be ignored;in the problem of the international trade single window dispute settlement,the appropriate institutional arrangements are lacked.In view of this,this paper aims to research more details of China's current four major FTZ of the international trade single window system,including legal basis at home and abroad of the FTZ single window system,the outstanding experience of the successful implementation in single window system of other countries or regions,the situation of current China FTZ single window system development,for proposing the suggestion of perfecting the single window system of China FTZ,for promoting the establishment of a unified national trade single window system.In addition to the introduction and conclusion,the full text is divided into the following five parts:The first part takes the basic theory of the single window of international trade as the breakthrough point,analyzes the definition and development of the single window system of international trade,combined with the benefit of each party in the implementation of single window,explains as a centralized trade facilitation measures the single window system plays a powerful role in trade facilitation.The second part analyzes the domestic and foreign legal basis of the implementation of the single window system of the China FTZ.The foundation of the international law are: the WTO law,the recommendations of the United Nations Trade Facilitation and Electronic Business Center and other international organizations regulations related to the single window system.Trimming the basis of domestic law through the drawing of two forms,and put forward suggestions to perfecting the domestic laws of single window system in accordance with the corresponding international law at the same time.The third part studied operation and charging system of the single window system,introduced the Singapore single window system named TradeNet operating system and charging system and the charging system of Hong Kong single window,and analyzed situations of single window in China FTZ on the arrangements of operation and the charges,put forward recommendations to improve operating system and the charging system of single window system in China FTZ.The fourth part studies the data sharing and protection system of the single window in China FTZ.Starting from the four aspects of the standardization of trade data,data quality,data sharing and protection,learn from Korean's standardization of single window data,United States single window system data sharing mechanism,"on personal data processing and free movement of personal protection directive" of EU,and according to the development of the status in the current four angles in China FTZ single window,put forward suggestions on the data sharing and protection system of the single window in China FTZ.The fifth part mainly studies the dispute settlement system of the single window of the China FTZ,focus on the choice of dispute resolution,the issue of jurisdiction and the legal choice of controversy on the current institutional arrangements of China FTZ.These cases may be about tort liability,data leakage or related to intellectual property rights in the legal dispute caused by the single window of the China FTZ.The last part is to give suggestion from the former three angles to perfecting legal dispute settlement system of the single window system.
