| Faced with the current trend of world integration, economic globalization and trade liberalization, and the new situation of domestic economy continues to deepen reform,innovation and development, the government decided to set up China (Shanghai) Pilot Free Trade Zone. It is a national strategy and a wise choice made for current domestic and international political and economic situation. The establishment of China (Shanghai) Pilot Free Trade Zone has great significance to the national reform and openness, and its robust,efficient operation. The robust, efficient operation cannot be without the guarantee of legal system. Therefore,since China (Shanghai) Pilot Free Trade Zone built, both central and local government have done very well to practice the requirements of law reform,including the relevant decisions made by central government which has make a guideline from the macro, and a series of regulations designed for legal protection by Shanghai local government. However, it is no doubt that because of the special properties and situation of initial construction, some relevant laws and regulations was failed to be launched timely, which means that China (Shanghai) Pilot Free Trade Zone, still has some problems to be solved in legal system. Here, based on background and significance of China (Shanghai) Pilot Free Trade Zone establishment, the author collate and summarize, its existing legal framework and reviewe the related institutional innovation. Meanwhile, the author also summarized the domestic construction experience on bonded legal and introduce foreign trade zone profiles of legal system,then get the advice to perfect the relevant legal of China (Shanghai) Pilot Free Trade Zone. Finally, due to the existing legal framework and the domestic and international experience, the author has made some suggestions and ideas of improving the legal system of China (Shanghai) Pilot Free Trade Zone for both central and area government.This paper is divided into five parts. The first part is introduction. A brief introduction to the research situation,research objectives and research methods of the topic. The second part is about the establishment of Shanghai Free Trade Zone. Including detailed analysis of the international and domestic context of China (Shanghai) Pilot Free Trade Zone established,describes the plight of legal construction in our existing Free Trade Zone,and summarized the enlightenment to the legal construction of the Shanghai Free Trade Zone. Finally, focuses on the significance and importance of the establishment of China (Shanghai) Pilot Free Trade Zone, as well as its legal system. The third part is the legal framework of China (Shanghai) Pilot Free Trade Zone. Combed the laws and regulations made by central and local government from the beginning of Free Trade Area established, then sorting out the current legal framework of the Shanghai Free Trade Zone, analyzed the contents of relevant institutional innovation, finally summarized the deficiencies need to be improved. The fourth part is the legal system of other countries and regions FTA and its Enlightenment on China (Shanghai) Pilot Free Trade Zone. Depending on the inductive of different FTA legislation and the legal system conditions of the United States, Turkey and Hong Kong, and summed up the Enlightenment to the legal construction of the China (Shanghai) Pilot Free Trade Zone. The fifth part is about improving legal system of China (Shanghai) Pilot Free Trade Zone. Combined experience of domestic and foreign trade zone and the existing legal framework of the China (Shanghai) Pilot Free Trade Zone,provide some suggestions and ideas of improving the legal system of China (Shanghai) Pilot Free Trade Zone for both central and area government. |
