New Development Of The Principle Of Common But Differentiated Responsibility And China's Countermeasures

On November 30,2015,the 21 st m eeting of the United Nations Framework Convention on Climate Change was convene d in Paris France,which lasted 12 days.Finally,the Paris Agreement was adopted.the interntional co mmunity's commen view on global clim ate change is f ully and deeply showed in the agreement,highlighting the balance between national benefits with inte rnational benefits.It is the m ilestone in th e global p rocess of improving climate change.There are 29 articles in the agreement in total,including all kinds of multi-responses to global clim ate issues.Especially,the application of the prin ciple of “common but differentiated responsibilities” has been further developed.This principle is the base of international environm ental law.The adherence to “common but dif ferentiated responsibilities” is the effective meaning of strengthening international cooperation during the process of global clim ate change;the development process of “common but dif ferentiated responsibilities” is the application process of this principle.The theoretical basis and practical basis of this principle determine that the principle must be conformed by the step of tim e.Therefore,it is necessary to pay close atten tion to the change of the principle “com mon but differentiated responsibilities”.Based on the background of global clim ate change,this paper f ocuses on the development of the principle “common but di fferentiated responsibilities” in the Paris Agreement,analyzing the deve lopment characteristics,and summarizing the corresponding countermeasures.This article is divided into five parts,includi ng introduction,overview,theoretical basis,new development,and challenges and response.The specific content is s et as follows:In the first chapter,the first part starting from the topic of the article introduces the international background of the “common but dif ferentiated responsibility” principle,exploring the practical signifi cance of the developm ent of the principle,expounding the research value from the purpose of the pape r research.The second part of chapter one summerizes the foreign research on the principle of common but differentiated responsibility,and providing the direction for the research of the topic,and pr ovide the writing material of the thesis.Finally,the last part of this ch apter summarizes the research m ethods and the innovative contents.The second chapter summ arizes the inside meaning,the historical background and the historical process of princi ples “common but dif ferentiated”.The historical developm ent process of the principle part is divided into four stages,including infancy,establishment,application and development.The third chapter introduces some basis theories.First,introduces some legal theories,including sustainable development,public trust and polluter paym ent;second,introduces the ethical theory,introduces the influence of non-anthropocentrism and environmental justice theory.Finally,explain the economic theory.Chapter four introduces developm ents of “common but differentiated” under the P aris Agreement.First of all,to explore the enrich ment and development of the principle in the connotation;Secondly,introduces the specific application of the principlet,including Intended Nationally Determined Contributions,International Finance Facility and Action and support transparency.Then explore the internationa l cooperation from four aspects under the new international background,cooperation basis,co operation subject,cooper ation benefits and cooperation mode.Finally,summarizes the characteristics and new meaning of the principle.Chapter five is the challenge and response of our country in the developm ent process of common but differentiated responsibility principle.First of all,it emphasizes the role of our country in the development of the principle.Secondly,it analyzes the challenges faced by our country.Finally,proposes advisements.Under the current situation,it is a great significance to explore how to prom ote the positive development of the prin ciple of co mmon but differentiated responsibility to improvement the global climate.
