The successive rulers have attached great importance to the practice of corruption and corruption.Among them,as an important part of the construction of the rule of law in ancient times,the system has been established since the founding of the Qin and Han dynasties,and has always run through the feudal autocratic society in China for more than two thousand years.It has provided a sufficient system for the construction of clean government.The construction of modern rule of law must be able to dig out the useful part of our national custom from the traditional legal culture and the theory of governing the country.Grasp the law,and absorb the essence.On the basis of inheriting the connotation of the rule of law in ancient China,the author puts forward the scientific and reasonable concrete system suggestion.This paper is divided into three parts,the first part briefly reviews the history of ancient China's generous salary system.Starting with the order of Emperor Han to increase the wage of officials,for the first time in history,clearly put forward the theory of salary and benefits.Then,mainly in the Northern Song Dynasty enacted "High salary law" as the carrier,analyzes the evaluation content standards and the implementation of the law of effects after combined with specific legal norms to grasp the essence of the ancient thought of rule by law.Then through the elaboration of Confucianism attaches great importance to the training requirements to officials of their own virtue and the traditional thought of advocating justice and the unity concept of these two aspects,discusses the ideological basis of the generous salary system.The second part is about the theory of human rights of the right to subsistence and development and from law and economics perspective,the applicability of this system is demonstrated.From the perspective of the theory of modern logic rationality of using the high salary against corruption in the construction of the modern system of the rule of law.The third part is in the fully investigated and analyzed the domestic and foreign anti-corruption experience,put forward the construction of the rule of law in modern China should cultivate the awareness of the officials,from the sound of corruption prevention laws and regulations and standard public servants wage setting three levels of standards,a mechanism to further promote the prevention of corruption.
