With the popularization of higher education and the transfer of the cost of education,many students from poor families in our country miss their ideal university because of economic difficulties.The implementation of the national student loans since 1999,helps many students from poor families successfully step into the classrooms of universities.Issues like bank credit crunch,student default loan,bank debt owed risk etc rise while student loan functions since it implements for decades so far.The reason is that the legislative system of the national student loans has not yet formed,there are conflicts between student loans laws and other regulations;the lack of personal credit of college students leads to the difficulties of the recovery of national student loans;the policy risks of national student loans;the standpoint of policy guarantee and the division of guarantee organization is not clear.Given the current national student loan problems,compared with the domestic and foreign relevant system and practice experience,the specialized "national student loan law" is suggested to resolve the conflicts between the relevant legal system legally;to promote the construction of college students credit legal environment;to establish the government based compensation mechanism and the national student loan securitization legal system to guard against the risk of bank creditor's rights;to clear the policy guarantee form of national student loan,and to clear the structural establishment and division of the policy guarantee.The purpose is to establish a healthy and sustainable national student loan mechanism,to promote the comprehensive and harmonious development of China's national student loan,and to promote the realization of the strategy of talent.
