Passengers inspection is the customs in accordance with the law to perform the regulatory functions of the inbound and outbound passengers and their baggage important functional departments,compared with other customs supervision department,passengers inspection department belongs to the typical "street bureaucrats" groups,passengers inspection department in the supervision work holds the important discretion,how to limit discretion in a reasonable controllable range,this paper is to discuss the main problems.The main purpose of this paper is to learn from the streets bureaucratic discretion management research,explore and improve the Passengers inspection discretion restriction supervision mechanism,guarantee discretion to exercise right,and make it become the beneficial supplement for the law.In this paper,from theory and practice both at home and abroad research on street bureaucratic discretion,expounds the connotation of the concept of customs passengers inspection discretion,analyzes its essential attributes,explains the legal basis and practical performance of discretion.Taking Changbei international airport customs as an example,the customs passengers inspection grassroots officials discretion to use present situation analysis,elaborated the existing customs Passengers inspection law enforcement and law enforcement supervision system operation process,and analyzes the passengers inspection discretion to control problems,including imperfect laws,the law enforcement difficulties,do not have a unified law enforcement standard,the performance of the grassroots officials who abuse of discretion and harm,and then to analyze the causes of the problem,there are mainly the system construction lag,lack of internal control,lack of constraint means,unified law enforcement can not effectively solve,etc.,and finally put forward the reasonable regulations passengers inspection law enforcement discretion in exploring methods,perfect the laws and regulations,strengthen internal control,to explore the construction of law enforcement unity,strengthening the team construction,strengthen the rule of law publicity and other aspects of reasonable and effective regulation,in order to put forward passengers inspection.
