Research On The Questions Of Discretion Of Law Enforcement Of H District Urban Administration From The Perspective Of Street-level Bureaucrat

On December 30,2015,the Guiding Opinions of the CPC Central Committee and the State Council on Further Reforming Urban Law Enforcement System to Improve Urban Management was promulgated.This is the first time that since the founding of new China,the Central Government has made a special plan for the enforcement of urban management.Since 2007,when the State Council launched a pilot program of relatively concentrated administrative punishment in the field of urban management,urban management and law enforcement departments have been set up one after another.The establishment of the urban management law enforcement department plays an active role in improving the appearance of the city,maintaining the urban environment,enhancing the image of the city and safeguarding the authority of the government,and plays an important role in the development of the city.At present,our country is in a critical period of economic restructuring and building a harmonious society.As the process of urbanization accelerates,the tasks of urban management are also getting heavier and heavier,with more and more contradictions and problems emerging.Urban management and law enforcement are also becoming more and more The focus of widespread concern in society.The life of administrative law enforcement lies in discretion.Urban management law enforcement is a typical street bureaucracy,as the end of policy transmission,not only the policy executor,but also because of the considerable discretion in hand,to a certain extent,actually become the policy makers,the decision will be made directly Affect the public's life.Discretionary power is a "double-edged sword",which can be beneficial to urban management to deal with various administrative law enforcement affairs flexibly and quickly and to realize the justice of individual cases.If abused,it will infringe the lawful rights and interests of the relative and endanger the society.How to properly control the discretion of the right to protect the legitimate rights and interests of the administrative counterparts to solve the problem of "short board" of urban management law enforcement,to enhance the level of urban management law enforcement and promote urban development is of great significance.From the perspective of street officials,this paper analyzes the performance of the Anomalous Discretion of Urban Management in H District,analyzes the reasons from the four aspects of administrative organization,law enforcement personnel,administrative counterparts,and law enforcement environment,and proposes solutions.
