On The Analysis And Reform Of Placement Assistance And Education To The Resettling Persons

Placement assistance and education is a non compulsory guidance, assistance, education and management activities to emancipist. At present, there are nearly one million release every year in China. If these people return to the society,who does not get the proper placement, they will crime again. This condition will bring great hidden danger to the social harmony and stability. Since 1949, we began to strengthen placement assistance and education in our country and lay down a series of standard and law, which promoted the social harmony and stability in the quite long time. Recent years, with the change of international environment and the rapid growth of China's economy, the traditional political,economic and social structure and people's views have a major change,which made a lot of troubles to placement assistance and education.In my paper, from the concept definition of placement assistance and education, I analyzed the object, content and method of this system, then compared the system of prison personnel management with the western countries. At last, I elucidated the realistic meaning of the job. I selected Shanghai as the research object and observed the placement assistance and education of judicial authority by the method of case analysis. In my analysis,I made a large number of case studies, interviews and so on to analysis the placement assistance and education in Shanghai from different views of the government agencies and the released prisoners. I found lots of questions of the placement assistance and education in China such as the backwardness of copyright legislation, institutional coordination, the backwardness of the team construction and so on in my research.I searched the reform of the placement assistance and education in three facts in order to promote the further development of the placement assistance and education in our country,that is improving and perfecting the legislation of the placement assistance and education,innovating the mode of the placement assistance and education, optimizing the supporting system of the placement assistance and education. First of all, the working mode of the placement assistance and education can develop three characteristic, which are marketization socialization and informatization. Secondly,a series of systems of the placement assistance and education should be made in legal form, and introduced incentive mechanism at the legal level. According to the practical aspects, absorbing social forces to participate in the systems of the placement assistance and education. At last, the rules of the released prisoners without discrimination in employment and making business should be worked out.
