A Study On The Legal System Of Green Credit In China

At present,the environmental problem has become a social problem,the consequences of environmental pollution has affected the economic and social smooth operation.In the capital of the core position of the financial institutions to credit to guide environmental protection,control of environmental pollution,green credit came into being.The construction of ecological civilization and the development of green economy have prompted commercial banks to strengthen environmental risk management and corporate social responsibility in their own development.Green credit as an economic lever for environmental protection,preferential credit policies for environmentally friendly enterprises and projects,and restrictive credit policies for high-polluting,high-energy-consuming enterprises and projects,with the aim of reducing environmental pollution through economic means.This paper aims to analyze the green credit and its related concepts,based on the analysis of China's green credit implementation status and its problems.China's green credit has been proposed for nearly 10 years,although the relevant departments introduced a series of green credit policy,to a certain extent,to avoid the commercial banks to carry out green credit process "bad money to drive good money" risk,but because of its lack of coercion,There are many problems with the implementation.Such as lack of green credit-related legislation,lack of bank social responsibility,lack of incentive mechanism,imperfect information disclosure mechanism,lack of supervision mechanism and so on.Therefore,only through the construction of China's green credit legal system,in order to protect the implementation of green credit from the legal level.On the basis of analyzing the feasibility of constructing the green credit legal system,we should learn from the legal system of green credit abroad,and choose from the basic principles,thechoice of legislative model,the scope of legal liability,the legal supervision system and the bank credit system This paper puts forward some concrete suggestions on how to construct the green credit legal system in our country,and tries to make the green credit in our country realize the sustainable development of economy,society and environment in the process of implementation.
