Research On The Police Personal Rights And Legal Protection

Polices of public security organs work in critical and complexenvironments,leading to increasingly prominent violations of police human rights.It is important to protect the rights and interests of the polices,and fight against the behaviors of damaging the police'sauthority and image.Standardization of law enforcement by the police is in contradiction with the law-consciousness of the masses,which makes it difficult for police's personal interestsprotecting.These problems now become urgent to be solved.For those reasons,this paper studies how to protect the police's personal interestsfrom legal perspectives through comparative analysis.The basic views of this paper include as follows,first,the protection of police personal interests under legislation construction andremedies adding to the guarantees of police personal interests;Second,in perspective of the police management system model,delocalization of human rights,power and financial rights according to the law,and compression of the local administrative control of the police power to achieve the independence of police;Third,in the field of cultural safety and legal protection,we need to improve the safety awareness of polices according to law and to establish a "people-oriented" security concept;Fourth,as to informationcontrolandsupervision,it is important to control public opinion,avoid manipulation from public opinion to police law enforcement,and combat violence of public opinion.Specific structure is as follows:The first part mainly elaborates the basic theory of the personal rights and interests of the polices,defines the connotation and category of the personal rights and interests of the police,and discusses the significance of protecting the personal rights and interests of the polices.The second part mainly expounds the behavior and constituent elements of the personal rights and interests of the polices,and analyzes the necessary restrictions on the infringement of the personal rights and interests of the polices.The third part mainly expounds the present situation and the reason of infringing upon the personal rights and interests of the polices,and expounds the performance of the personal rights and interests of the polices through the polices' activities.The reasons for the failure of guarantees are introduced from the omission of legal security system,the lack of social cooperation and weak awareness of the main interests of the polices and other aspects of the police's personal rights and interests.The fourth part mainly elaborates the investigation of the personal rights and interests of the polices outside the country,and analyzes the guarantee system of the police rights and interests in outside countries and regions,and then discusses the wisdom of our country in protecting the personal rights and interests of the polices.The fifth part mainly discusses the four aspects of strengthening the legal construction,standardizing the police management system,constructing the police safety and culture legal guarantee and strengthening the control of public opinion on polices from the legal points,so as to protect the personal rights and interests of the polices.
