The Empirical Research On The Procuratorial Synchronous Audio And Video Recording System Of Interrogation

The procuratorial synchronous audio and video recording system,which have played a positive role in standardizing the law enforcement investigation and protecting the suspect's legitimate rights,began to implement since 2007.However,it had encountered some difficulties in practicing this system.The legal status of synchronized audio and video recording system was established since 2013 when the amendments to the "Criminal Procedure Law" had been promulgated,which brings new impact to the procuratorial organ in handling the duty crime cases,and implementing the synchronous audio and video work.In This paper,from the example of N city Z Province,the author surveys the whole city's procuratorial organs for their synchronous video recording work;carried out a empirical research of procuratorial synchronous audio and video recording system based on the survey data,summarizes the legal issues,and puts forward some improvement suggestions.This paper comprises of four chapters with more than 34000 words.Chapter 1 summarizes the current situation of the procuratorial synchronous audio and video recording system.First,this chapter discusses the development of the synchronous recording and video recording system in our country.Second,it elaborats the synchronous recording system regulations of the Supreme People's procuratorate.Third,this chapter discusses the characteristics of the procuratorial synchronous audio and video recording system,combined with the current academic perspective,put forward some of the author's own viewpoints.Finally,it elaborates the major functions of the procuratorial synchronous audio and video recording system,focuses on the protection of the suspects from the improper inquisition and torture,the supervision of the interrogation process,and the protection of the investigators themselves.Chapter 2 describes the practice of the procuratorial synchronous audio and video recording system in N city.First,this chapter discusses the establishment and standardized construction of the procuratorial synchronous audio and video recording system in N city,and expounds the delopment process of the synchronous recording system in N city.Second,it analyses the technical configuration of synchronous video recordings equipment in N city procuratorate,carries out data statistics and comparative analysis from the staffing and hardware equipment configuration.Third,this chapter discusses the implementation of N city's procuratorial synchronous audio and video recording system,from the following three aspects:the statistics of synchronous video recording,the preservation of optical disk material,and the signature confirmation of suspects.Finally,it analyses the video demonstration of N city's procuratorial synchronous audio and video recording,the specific methods of operation and further research of synchronous audio and video information to the investigation and supervision,prosecution and court demonstrate.Chapter 3 discusses the existing problems in the procuratorial synchronous audio and video recording system in detail.This chapter mainly elaborats from three dimensions:the legislative level,practical level and technical support.It analyses the the existing problems in the procuratorial synchronous audio and video recording system,discusses the difficulties encountered in practice such as the video scope is not clear,the recording subject is not neutral,recording evidence attribute is not clear,and so on.Chapter 4 is mainly about the suggestion and perfection of the interrogation synchronized audio and video recording system,puts forward some suggestions and opinions on the perfection of China's procuratorial synchronous audio and video recording system.It analyzes and discusses the system from three aspects: the improvement of legislation,standardize the operating procedures,strengthen the supporting system.
