Interrogation Of Duty Crime Suspect Fully Synchronized Video Recording System Research

Established by the Supreme People’s Procuratorate of the People’s Republic of China to standardize enforcement behaviors and promote integrity, the system of synchronous audio and video recordings in the whole process of interrogations of duty crimes suspect has obtained a positive effect in preventing extortion of confession by torture and protecting human rights.This essay begins with the background of the establishment of the system of synchronous audio and video recordings during the whole process of interrogations of suspect of duty crimes. After introducing concepts relating to this system, the author further studies on the legal nature of the system. The author holds the opinion that the content of the audio and video recordings should be regarded as a kind of procedure evidence, which should be used to testify the legitimacy of interrogations courses.By surveying on the systems of audio and video recordings of interrogations in several countries, the author has found out something useful in perfecting our system of synchronous audio and video recordings in the whole process of interrogations of duty crimes suspect.According to the real situation of China’s implementation of this system, the author finds out the problems in the implementation of this system,which are resulted by the system itself and those who irrationally implement the system. Then the author further analyses the causes of the problems, which mainly includes:obscurity in legal status, lacking of materials and human resources, unchanged ideas in enforcement, poor investigating abilities and lacking of supervision mechanism.According to the current situation of our country, the author also carries out suggestions on perfecting the system of synchronous audio and video recordings in the whole process of interrogations of duty crimes suspect, which mainly includes:to set up the legal status, to expand the scope, to establish supervision mechanism and enhance standardization. Furthermore, the author also proposes to strengthen basic safeguard and establish supplementary measures so as to perfect safeguard mechanism for the system.
