With the formidable lethality and mentally deterrent force,guns,in contrast with other arms,have been more jeopardized to society,and can easily cause severe harms to other personal right,as well as private and public property.This paper will focus on discussing the detective and prevent mechanisms for one type of gun-related crimes that gun itself is an object of the crime,and the paper can be divided into three internally logically-coherent parts:The first part defines the gun-related crimes.Guns in this kind of crime refer to the standard firearms with four necessities of “power,shoot,bullets and lethality” and non-standard firearms that can discharge standard ammunition.China's Criminal Law does not specifically categorize gun-related crimes into a single charge.Gun-related crimes,where gun itself as an object of crime,mainly refers to two types of crimes,trafficking guns and holding guns.Elements forming the gunrelated crimes consist of the subject of a crime,the object of a crime,the objective and subjective aspects of a crime,etc.And it has distinct characteristics in the subject of a crime,criminal behaviors and time and space of a crime.The second part correspondently analyzes the problems in investigation mechanism and prevention and controlling mechanism of gun-related crimes.Based on the traditional experience,the existing mode of investigation is “moving and fighting” crimes.In dealing with more complex crimes,the lagging responses of investigation,the poor communication and cooperation,and the deficient guarantee of investigation,have greatly weakened the efficiency of detecting gun-related crimes.Apart from state's inspection and disposal for the gun-related crimes,the prevention and control is also essential to gun-related crimes.However,there are some problems relevant to the prevention and controlling mechanism in our country,mainly represent as the gun transactions on line making it more difficult to control the gun-related crimes,and the inadequate social prevention and controlling system resulting in controlling loopholes,and so on.The third part puts forward some pertinent suggestions on the improvement of the investigation and prevention system.The investigation and prevention system should be improved thorough establish a quick response mechanism for the inspection of gun-related crimes,smooth the multiple-level of cooperative channels for gun-related crimes,and the reinforcement for the inspective guarantee of gun-related crimes.Corresponding to the problems in the prevention and controlling mechanism for gun-related crimes,managements that the prevention and controlling for key person should be strengthened in the present situation of the networked gun transactions.In addition,the circulation of the necessary items for gun production should be restricted.The publishers,transmitters and network service providers of illegal guns information should be punished,and strengthen the regulations for express delivery,E-business and communicational industries,with a sound institution to plug the loopholes of social prevention and controlling system.
