Legal Consideration On The International Cooperation Of Air Accident Rescue

With continuous breakthrough of global aeronautic technology,taking a flight has become a very important way of traveling in human life.However,in recent years,many air accidents have taken place all around the world,which brings us much shock and grief.Air accident is different from ordinary accidents,because of its great damage to human lives and properties.What's more,air accident is of obvious international character,for the damages it caused are usually associated with different countries and areas.There is no denying that out of all the methods to save the loss,air accident rescue is the fastest and most direct approach.After an air accident,the rescue cooperation of related countries covers the conflicts between their different politics,economy,military,technology and culture.As two inevitable principles in the study of air accident rescue,Non-Interference in Other's Internal Affairs and Human Rights First reflect the main conflict in the International cooperation of air accident rescue.There are still a lot of problems.First,the regulations related to international cooperation of air accident rescue are not systematic.They appear in scattered international treaties without specification.Second,in these international treaties,there is no legal basis for both the function method of coordination mechanism and supervisory mechanism and the determination and operation mode of the leading country in rescue subject.Besides,air accident rescue is now confronted with tremendous political resistance.Under the influence of this political resistance,the process of friendly rescue would easily descend to an opportunity for many countries to show their military force,and inappropriate rescue methods might bring damage to the sovereignty of some countries.Both domestic and foreign scholars have studied the content of international rescue cooperation at a certain depth,usually on the classification basis of rescue methods.However,the study can be more pertinent when we observe international rescue cooperation from an air accident perspective.In this way,all the rescue methods can be integrated.Therefore,international community should pay enough attention to air accident rescue by constructing the legal system of the international cooperation of air accident rescue,and regulating the working procedures of coordination authority and supervisory subject.Besides,the legal status of the leading country can be consolidated when its formation and working procedures are determined.After unifying the specific items of air accident investigation,replacing country's rescue force with territorial rescue force and reducing political resistance by establishing the prohibitions of air accident rescue,the international cooperation of air accident rescue can be perfected.
