The Establishment Of A Legal Cooperation Mechanism For Search And Rescue In The South China Sea

The South China Sea issue is a hot topic in international public law and the international society.The dispute over sovereignty between the coastal states of the South China Sea has aroused widespread concern,but the security and cooperation among the countries in the South China Sea cannot be ignored.In this paper,a small entry point that is the maritime search and rescue cooperation to explore how to establish the legal cooperation mechanism of the search and rescue of the South China Sea.As the maritime search and rescue concerns the protection of life and property safety of people around the world at sea,the South China Sea countries use the legal mechanisms basis on the construction of effective search and rescue cooperation is very necessary,therefore,the results of this study will also bring great practical significance.The existing research on the legal mechanism of search and rescue cooperation in the South China Sea is one of the few,and has some limitations,for this,this paper will be more comprehensive,long-term,pragmatic vision to explore the search and rescue mechanism established in the South China Sea,Which will bring theoretic guidance for the practice of the South China Sea search and rescue legal mechanism.The first part of this paper start from the concept of maritime search and rescue,discusses the definition and characteristics of maritime search and rescue.At the same time,based on the concrete data and case,it shows the specific situation of marine accident in the South China Sea and the legal cooperation status of maritime search and rescue,which paves the way for the discuss of the establishment of the legal cooperation mechanism.The second part of this article is actually an extension of the first part of this article,focusing on the introduction and evaluation of existing international law mechanism of the South China Sea.First of all,it introduces the international conventions,bilateral treaties that the countries in the South China Sea have joined and their and domestic legislation,and points out the limitations of existing international law mechanisms,and then emphasize the importance of setting up and perfecting the mechanism of legal cooperation.The third part of this article discusses the establishment of the South China Sea search and rescue bilateral treaty.Start from analyzing its feasibility and necessity,and then elaborate on how to build the South China Sea search and rescue of bilateral treaties.In the specific discussion of the establishment of bilateral treaties,the first analysis of China to promote the establishment of bilateral treaty specific path,and then discuss what specific content the bilateral treaty should include.The fourth part of this paper discusses the establishment of the South China Sea regional search and rescue treaty.On the basis of discussing the feasibility and significance of the establishment of the regional treaty,this paper discusses the way of signing the regional cooperation treaty of South China Sea.When discussing its approach,it start with how to make the regional cooperation treaty signed lead by our country and then make suggestions on the content of the regional cooperation treaty.
