Studying On The Identification System Of Toxic And Harmful Food In Criminal Proceedings

When food safety has gradually attracted people's attention,food safety crime has seriously affected people's lives healthy and safe.In order to punishment,there is a need of the new situation of food safety crime unique identification system in criminal proceedings-----food identification system.Different from the ordinary forensic identification,the characteristics of food is easy to corruption,perishable and difficult to store.Also it's difficult to save in practical operations,need to identify the relevant food,issued identification and related test reports As part of the chain of evidence after the criminal proceedings.However,according to China's current judicial identification system,and there is no clear identification of food identification,which led to a series of issues which are a lack of legal provisions in a lot of food identification,imperfection of institutional settings,confusion of identification of personnel management and less rigorous of identification procedures.This issues influence the process of criminal proceedings,so that many cases "difficult to detect,difficult to convict" situation.It is still a lot of deficiencies in China's forensic system before.There is no clear provisions of the special requirements for food safety identification in China's existing judicial identification system.In recent years,with the deepening of China's judicial reform,the provisions of the judicial appraisal become more and more perfect.It also appeared relevant laws and regulations on the food identification requirements.Although China's food identification system has made some progress,but still have a lot of deficiencies compared with the developed countries of the perfect judicial system.The first part of this paper introduces the current status of China's food identification system and foreign food identification system.The second part analyzes the important role of food identification system in criminal litigation from the theoretical point of view.The third part puts forward the problems of food identification system.In view of the above analysis,in the fourth part put forward the perfect countermeasure.These are Suggestions: to further improve the legal system of food identification;the establishment of professional norms of food identification procedures system;improve the administrative organs of the collection of food drug identification criminal conversion procedures;comprehensive strengthening of food and drug testing and testing technology and level;the establishment of a unified standard information technology sharing Platform;set up food and drug identification expert library;improve the food identification of the pre-court program.
