The Contracted Management Of Rural Land Subcontracting Effectiveness Research

Chinese rural land contractual management right has been circulated and developing for over 30 years,and several kinds of rural land contractual management right occurred during the period in the form of subcontracting and transferring.Subcontracting is the earliest,widest use and most representative methods.However,academic community prefers the means of circulation,which promote the development of rural economies like the general rural land contractual management right or new type like taking shares as mortgage,the research on subcontracting is relatively few.While from the respective of the writer,subcontracting is still an important method for load of rational disposition,and it is an important part of the rural contracted land management right transfer system.Meanwhile the effectiveness of the subcontracting is also the hot and hard point for the court of justice to hear the case about the transferring of land use rights.This article will start from the historical development and concepts and features of the subcontracting combining with empirical cases to analyze all kinds of issues about the effectiveness of subcontracting the right of contracting and managing farmland,and provide the way to deal with the dispute created from the subcontracting about Chinese rural contraction for the managerial right,and provide revolutions and advices on the legislation about the rural land contractual management right.
