A Study On The Laws And Regulations System Of The Organizational Work Of The Communist Party Of China

Since the 18th National Congress of the Communist Party of China(CPC),the CPC Central Committee has made a series of important arrangements for the system of the party's internal laws and regulationsand its construction,by a comprehensive strategy ofgoverning by law and strengthening the Party discipline.General Secretary Xi Jinping stressed that the Party should go to great lengths to promote the formation of the effective and complete laws and regulations system with coordinate content and strict procedures within the Party with Chinese characteristics.The Decision of the Fourth Plenary Session of the 18th CPC Central Committee put "the formation of the complete laws and regulations system within the Party" into the overall goal of comprehensively promoting the rule of law.It is of great significance to promote the construction of the laws and regulations system of the Party's organizational work because it's an important component within the Party,but the task is difficult and time is pressing.However,the research on the construction of the laws and regulations system of the Party's organizational workis very limited in the current academic field,especially the law theoretical field.Besides,little research has been carried out from the perspective of law.This papertries to explore the construction of a more comprehensive,more mature and better-shaped laws and regulations system of the Party 's organizational work in accordance with the current situation.On the basis of the Party's important laws and regulations issued during more than 90 years since the establishment of the CPC,this paper comprehensively applies the methodologies of materialistic dialectics,literature research,comparative analysis,empirical analysis and so forth.Firstly,it examines the theories about the Party's laws and regulations system of organizational work to clarify the connotation of the system.It also analyzes the relationship among law,the Party 's internal laws and regulations,and the Party's laws and regulations system of organizational work.Through this,it illustrates the practical significance of the system construction of the party's organizational work.Secondly,based on three stages of the new democracy period,the socialist revolution and construction period,the reform and opening-up and the socialist modernization construction period,this paper reviews the development process of the party's laws and regulations system of the organizational work over the past 90 years,analyzing the characteristics of the Party's system of its organizational work in each historical period.On such basis,it summarizes the important achievements of the system construction and valuable experience accumulated in the long-term practice.After that,it studies the existing problems,weaknesses and their reasons in the construction of laws and regulations system of the party's organizational work.Finally,the paper focuses on examining the choice of the path for the construction of laws and regulations system of the organizational work in the new period.It puts forward the idea from the aspects of the overall goal,basic principles,main frame,and ranks and levels of the construction of the system.Moreover,this paper explores the basic methods of constructing the system so as to provide a strong system guarantee for promoting the reform of the Party's construction system and improving the Party's leading and governing ability.
