Research On The Guarantee Mechanism Of Circular Economic Law Of Green Development

Traditional extensive economic development pattern in our country in promoting rapid economic development at the same time,also creates ecological problems such as environmental pollution,resource depletion,a direct impact on the sustainable development of economy in our country.Green development has become the only way to adapt to the sound economic development.It is the fundamental way to solve the resource and environmental problems and the inevitable choice to realize the Chinese dream.With the amendments to the constitution of the People's Republic of China ","" the general civil law of the People's Republic of China,respectively,to ecological civilization coordinated development,green principles incorporated in the basic law of our country,marked the country to the strong determination to protect the ecological environment.Although green development has become a consensus,but for the green development concept,connotation,implementation approaches and methods and so on question discussion,there is controversial,lead to a larger green development practice of confusion.The purpose of this paper is to clarify the basic theory of green development,on the basis of a clear legal support is necessary element in the development of green,and the relationship between legal system of circular economy and green development more closely,more directly,so the circular economic law safeguard mechanism study of green development,to guarantee the smooth implementation of the green development from the legal level.This article selectively draw lessons from Germany,Japan,the United States on the basis of circular economic law protection experience of the development of green,combined with China's national conditions,put forward from two aspects: macro and micro circular economic law guarantee mechanism to improve the green development.At the macro level,we should build a top-level design for the coordinated development of government promotion mechanism,market regulation mechanism and public participation mechanism.At the micro level,from the legislation,law enforcement,judicial and law-abiding four aspects,a suggested producer responsibility system,perfecting laws and regulations in the development of green circular economy and supporting measures,promote clean production and waste reuse and recycling products,enhance the recycle of resources,encourage recycling consumption and so on,in order to circular economic law safeguard mechanism of the development of green building in China put forward feasible Suggestions.
