Countermeasures Study Of Personal Information Protection In Network Environment

Under the environment of information society,the issue of personal information protection has been gradually taken seriously.The protection of personal information is closely related not only to the interests of the individual,but also to the healthy and effective development of the social economy.At the same time,the network has become a part of people's life,the spread of personal information in network environment is more rapid and convenient,but it also means that the protection of personal information will become more difficult.Compared with the general environment,the phenomenon of personal information violation is more prominent in reality.At present,there is not a specific law in our country to protect the personal information comprehensively,but it is scattered and generally stipulated in some laws.Therefore,it is very necessary to establish a systematic and comprehensive personal information protection system.I choose to put forward the research countermeasure to the protection of personal information under network environment from civil law,mainly because the protection of civil law is the protection of rights under the premise of freedom and equality,and the protection of the land is more comprehensive.There are five parts in this paper:The first part: the question is put forward.First of all,the two typical cases,namely,"Xu Yuyu telecom fraud case" and "Tsinghua teacher fraud case" are introduced.Secondly,it leads to the problems in the case.The second part: analyzes the particularity of personal information protection under network environment.It mainly discusses the meaning of personal information,the characteristics of protection and the specific ways of being infringed in network environment.The third part: summarizes the current legislation and the difficulties faced by our country's personal information protection under network environment.The current legislation includes direct legislative protection and indirect legislative protection,while the predicament is explained from three aspects: confirmation,relief and supervision.The fourth part: introduces the legislative protection of personal information outside the country.Mainly represented by the European Union,the United States and Japan,and based on the analysis,we can draw lessons from our country.The fifth part: puts forward the legislative proposals to perfect our personal information protection in network environment.It is mainly perfected from five aspects: the establishment of personal information right,the reversal of the burden of proof of tort,the introduction of public interest litigation system,the establishment of supervision and management system and build the network "free + pay" dual protection mode.
