Study On The Domestic Violence Among Minors And Prevention And Control Measures

Due to the influence of traditional concepts,the prevention and control of women's domestic violence has long been the focus of China's theory and practice,and it has generally ignored the serious situation of the domestic violence of minors.Compared with the domestic violence that occurs between adults,minors are not mature in physical and mental development,self-protection awareness and lack of ability,and the harm caused by domestic violence is often more serious.In China in2016,although the anti-family violence law enforcement is special prevention and control of family violence first legislation,but in general,the legislation did not reflect enough attention of domestic violence prevention for minors,unreasonable minors to define the meaning of domestic violence,not set a special chapter system comprehensive for minors of domestic violence prevention provisions,rules are still many deficiencies.In view of this,it is of great significance to establish a comprehensive social control system to safeguard the interests of minors and promote family and social harmony.This article selects two typical cases of family violence minors for introduction,through the exploration of the concept of domestic violence at home and abroad about minors,based on the related research,combined with minors,the characteristics and causes of domestic violence from the subjects of violence,violence,violence type,reporting and disposal situation of minors five main aspects analyzed combing the current situation of domestic violence,it is concluded that the present stage of minors family violence,harmful consequences,but the legislation is not perfect,the social universal problems such as insufficient effective intervention.In comparison,the legislation and system of foreign countries and some regions are more advanced and worth learning.In this paper for the United States,Japan,Taiwan domestic violence prevention and control of minors in the legislation and the current legislation related system has carried on the detailed comparison,reflect on the main problems existing in the legislation of our country.Adhere to the problem oriented,this paper suggested anti-family violence law establishes the principle of best interests to protect minors,set the domestic violence prevention and control of minors problem discussed with system,further improve the safety protection,custody deprived of related system,at the same time to strengthen the public power for juvenile violence intervention,especially to strengthen the relief function of the civil affairs department,establish and improve the social control mechanism,give full play to the kindergarten,school,community and its grass-roots institutions,such as social work for domestic violence relief assistance of the parties.We should reverse the concept of ideology and protect the interests of minors.It is expected that the research of this paper can help the prevention and control of juvenile domestic violence.
