Study On Community Correction Cohesion Mechanism In China

Community correction in our country started in 2003 as the pilot project,and this work has been implementing for 15 years.This work has made great progress with developing and improving the system of penalty execution,and also made contributions to social management.With the comprehensive promotion and deepening of community correction,some new problems have been encountered in the work,especially in the work of community correction cohesion.The main manifestation is: lacking of cohesion cooperation measures,the provisions of the various departments to deal with the problem disunity,the problems of receive and imprison in judicial practice and so on.To this end,the ministry of justice jointly formulated “the opinions on further strengthening the cohesion and management of community correction work”,with the supreme people's court,the supreme people's procuratorate and the ministry of public security(hereinafter referred to as "the opinions"),This is a matter for the community correction cohesion of the agencies,to clarify the work process and the responsibilities of the job,to make sure that the work of the society is properly applied and regulated by the law.In the judicial practice,however,there are still some problems in cohesion and coordinate,such as difficult to receive,difficult to carry out the system of imprison.These problems hinder the community correction procedures,and also influence community correction effect.This paper analysis “the opinions” and the working practice of community correction.Then focuses on the research of community correction cohesion mechanism and discusses in the following aspects:The first part is the introduction.Firstly,a case of putting in prison used to introduce the topic,further elaborates the purpose and significance of the research topic.Secondly,this paper analyzes the research focus of community correction at home and abroad,the problems,causes and countermeasures of community correction cohesion in domestic researches,and the experiences of other countries.The second part is an overview of community corrective bridging mechanism.First of all,this passage got the basis of theory and experience,based on the analysis of the "cohesion andmanagement opinions",to clarify the basic connotation of community correction cohesion mechanism.And then the passage will analysis the relevant theories,and will explore the value of cohesive devices.The third part is the problems and the reasons for the problems in community corrective cohesion.The passage analysis of the problems existing in the practice of community correction cohesion from the angle of the penalty practice,including the four procedures: In the decision procedure,the difficulty to determine the place of residence and the non-unification of social investigation.These problems wasted judicial resources.In the delivery and receiving procedure,the delivery of personnel and legal instruments is not uniform,which may cause the leak-proof manifold.In the supervision and management procedure,it is diffident to determine the detached from supervision.And it is difficult to connect with pubic security in tracing activity.In the procedure of changing the penalty enforcement measures,the connecting procedures are not specific and can't be completely implemented in application.At last,the passage discussed the reasons for the problems: the system,the procedure,the communication and the limited measures.The fourth part is the countermeasures of improving the community corrective bridging mechanism.The passage tried to put forward some views and suggestions to improve the cohesion of community correction mechanism,which hoped to more detail of the processes associated with community correction cohesion.One is clarifying the system of cohesive work in community correction.Two,improve the procedures.Three,strengthen the communication between them.Four,by enriching the means of supervision and other administrative penalty measures,reduce the cohesion program.At last,the passage hopes to make a little effort for the theory of the community correction cohesion mechanism,eventually better applied to serve the community correction work in practice.
