Problems And Perfection Of Community Correction In Rural China

With the progress of social civilization,the constant development and improvement of the legal system,and the enhancement of the concept of the legal system of the general public,the law has made it more humane and socialized that some of the criminal acts are increasingly adapted to the trend of legal development.Under such circumstances,The system of community correction came into being,and has been widely applied and achieved good social effects in some developed countries and regions.At the same time,China's community correction system is constantly under construction and development.From July 10,2003,China started to carry out community correction pilot work in individual cities according to suggestions made by scholars.It has been 15 years since.The 2011 Amendment to the Criminal Law(8),the Criminal Procedure Law of the People's Republic of China revised in 2012 and the Measures for the Implementation of Community Correction on March 1,2012 have confirmed the legal status of the community correction system in the execution of penalties.However,we also found that the community correction system has appeared acclimatized in the development of China and has encountered difficult problems.Due to the fact that our country is characterized by a dual system of urban and rural areas,unbalanced development between urban and rural areas,and differences in urban community correction and rural community correction,rural community correction work is more difficult and slower to carry out than the urban areas,with the problems being more prominent Due to the level of economic development in urban and rural areas,the development of rural communities and urban communities,and the different qualities of citizens and villagers.Therefore,the concept of serious penalty exists in a large number of rural areas.Therefore,the villagers have a low recognition of community correction and do not actively participate in it.The allocation of funds at all levels in the county and townships is unbalanced.Infrastructure construction and community development in rural areas are lagging behind,Lack of professional staff;poor cooperation and cooperation between work departments;community correction work is not in place;community prisoners are not easy to accept supervision and so on.Therefore,we need to strengthen publicity in rural areas to eliminate the villain's idea of serious punishment;standardize the functions and coordinate the relations among relevant departments;enhance the strength of community correction teams in rural areas,improve the quality of community correction staff and improve the management level;Use the cutting edge,the main tasks and requirements of community correction in rural areas put in place;promote the construction of community information in rural areas.Starting from the national conditions of our country,we not only absorb the successful experience of other countries,but also innovate and make breakthroughs.We are endeavoring to promote the community correction in rural areas of our country and provide valuable experience for the formation of the rural community correction model with Chinese characteristics.The research content of this paper is the problems and improvements in China's rural community corrections.Take W County as an example,use field research methods to conduct questionnaires and conduct interviews with the local community inmates,the public,community correction staff,etc.to understand community corrections.Problems existed,and then analyzed the problems and put forward measures to improve community corrections in rural areas in China.In addition to the introduction and conclusion,this article is divided into three parts.The first part mainly discusses the concepts and theories related to community correction.This paper introduces the properties of community correction and makes a clear definition of the connotation and characteristics of rural community correction.It points out that the significance of community correction in rural areas provides the support for the later discussion of community correction in rural areas.The second part mainly analyzes the current situation of rural community correction in our country.Community correction is endemic,and community correction will be different depending on the culture of different regions and different community environments.In this paper,we choose W County to conduct a field survey,W County field survey to understand the W County community correction status and the main problems,the strength and contribution of the community in W County is still at a low level.The humanization of community construction and community services needs to be further improved;the technical use of community correction cannot keep up,the supervision is relatively backward,and the special funds of the Justice Bureau cannot be guaranteed;Many mechanisms in rural areas remain stuck with higher levels of inspections.There is no good adaptation mechanism,etc.and then analyzed the reasons for the problem.The third part mainly refers to absorbing the advanced experience both at home and abroad,and puts forward some suggestions for improving the community correction system in rural areas of our country.Such as: speeding up the construction of new-type rural communities;speeding up the construction of community-rectified infrastructure in rural areas;intensifying the propaganda of community corrections in rural areas;solving the funding support for community corrections through various channels;establishing and improving interdepartmental linkage mechanisms to achieve community corrections Seamless docking;the establishment of a professional community correction project;enhance community correction work team building.
