Conflicts And Coordination Between Citizens' Petition Rights And Local Government's Maintenance

In China,petition remains to be the most traditional and life-oriented method for the public to make their appeal.It serves as the last line of defense.Given the numerous reports concerning citizens? being “educated” and “demonized” and conflicts between the public and the government,the issue of protecting the right of petition for public and regulating the local government?s measures of stability maintenance.Based on discussions of concrete examples concerned with above two aspects,this paper intends to probe into the internal mechanism and the deep reasons,attempting to propose a win-win method.The first part of this paper mainly introduces the concept of citizens' right of petition and the maintenance of local government,and sets up a theoretical framework which includes political participation theory,social conflict theory,social stability theory,game theory and governance theory.The balanced relationship between right protection and government maintenance is highlighted through the analysis.The second part analyzes the status quo of the conflict between citizens' right of appeal and local government.It intends to describe and summarize the current situation from perspectives of value orientation,goal pursuit and behavior strategy.The third part summarizes the game mode of citizens? right of petition and local government maintenance,including the negative and game mode of citizens' right of petition and local government maintenance,the zero-sum game mode of citizen's appeal to win power,the zero-game mode,the citizens' right of appeal and the local government to maintain stability and the game model,and in the specific mode of each model to summarize its actual performance,namely: linger mode,leapfrog escort mode,continuous petition mode,profit petition mode,The analysis of the strategies and behaviors adopted in the process of maintaining the stability of the local government is also helpful to the following aspects: the conflict between the citizens' right of appeal and the local government,and the stability of the local government.Reason explanation.The fourth part summarizes the governance techniques of the local government to suppress citizens' right of petition and appeal,including multi-channel comprehensive management,relational repression,official bargaining,violent interception,and analyze the characteristics of specific governance measures,and makes a comprehensive analysis.The fifth part explores the inherent crux of the conflict between the citizens' right of appeal and the stability of the local government,mainly from three perspectives,namely,the citizen's own factors,the government's top-down centralized system and the local government's response to the institutional.The sixth part tries to put forward suggestions for a balanced relationship between the citizens' right of appeal and the stability of the local government,aiming to contribute to long-term social stability.
