Discussion On Network Law Enforcement Dilemma And Corresponding Measures

Without law,the state can not be governed and the network can not flourish.In the Internet age,we must closely rely on cyber space rule of law,which can strengthen the network legislation,strict network law enforcement,and guide users to respect the law.Network law enforcement as a key part of the legalization of cyberspace is indispensable in China's power strategy.Although China has made some achievements in the network law enforcement,but there are still many problems.In order to effectively protect the legalization of cyberspace and the continuous construction of network power we must study the network law enforcement and law enforcement dilemma,put forward the corresponding countermeasures for the dilemma.Based on the research of the domestic and foreign scholars,this paper focuses on the dilemma faced by the network law enforcement and tries to put forward the corresponding countermeasures and suggestions for the law enforcement dilemma.The main contents include:First,starting from the point of view of administrative law enforcement,the conceptual definition and characteristics of network law enforcement are analyzed,and the theory and basis of the three theories are introduced.Second,according to the development of network and network legislation,the development process of network law enforcement is divided into the initial exploration stage,continue to promote the stage,strengthen the development stage and comprehensive coverage stage.according to the law according to these aspects of China's network law enforcement at this stage facing the plight.Third,we analyze the focus of four countries of the network law enforcement model,such as the United States,Britain,South Korea and Singapore.Through the analysis of the network enforcement modes of these four countries,the relevant experiences are summarized from the three aspects of law enforcement subject,law enforcement and law enforcement.Fourthly,on the basis of the previous research,combined with the actual situation of China's network development,the author puts forward the law enforcement concepts and tries to improve the law enforcement The effectiveness of electronic evidence,improve the construction of law enforcement team and the network legal system.
