The Barriers And Path Of Ecological Patent Law

Ecological patent law puts ecological considerations that protecting environment into the patent law,through patent application,patent grant,patent invalidation,patent enforcement to reduce environmental negative effects of the technology.In this article,we use literature analysis,domestic and foreign patent law policy research,China's actual situation analysis to value the barriers and feasibility of building suitable ecological system of the patent law.The paper expounds the barriers in theory of the patent law and environmental law on environmental protection.We expounds the feasibility of the ecological patent law by analysis of the ecological effect of patent and the limitation of environmental protection of environmental law.Then we propose an appropriate ecological system of the patent law.
