Adherence to the party leadership is the fundamental guarantee of the people being the masters of the country and ruling the country by law.Under the background of the rule of law,the Central Party issued Opinions of the CPC central committee on strengthening the legislative work of the party leadership in 2016,which further pointed out the need to strengthen the party's leadership in legislative work on the basis of opinions in 1991.The opinions show that our legislative work is under the leadership of the party for a long period of time.Under the guidance of the above two documents,the party leadership of our party has formed a routine practice in the field of practice.Analyzing the party leading legislative work from the point of procedure,whether from the central level to the local level,or from the beginning of leading legislative work to the end of consideration,there just forms a set of legislation practice on which the procedural aspects of the rules are unclear,incomplete and non-specific and lack of unified procedural norms and system design.And it didn't deal well with the relationship between the party,the people's congress,its standing committee and the government.Through the practice of the party leadership legislative work specific form of investigation and summary,the party's leadership in legislative work is mainly manifested in usual practices as proposing for legislation,reviewing five-year legislative plan annual legislative plan,coordinating and resolving major legislative controversy,reviewing and determining major legislative matters and the party group requesting instructions and submitting reports to the party committee and so on.Under the guidance of the rule of law to realize the legalization,the party leading legislative work needs to abide by the basic requirements of the procedure that the modern rule of law emphasizes and realize highly procedural just as legislative work.The procedure makes the party's leadership in legislative work under the guidance and regulation of relevant procedures.Besides the opinions also pointed out that "it's necessary to improve the party's decision-making process on major issues".On this basis in order to form procedural specifications and to deal with the relationship among the party,the people's congress and the government,from the perspective of improving the inside-party procedure,the bridging procedure between the party and the legislature and the legislative process,the paper focus on putting forward program specification advice on the concrete operating level as well as the basic theory of level about the party leading specific legislative work,and solving the procedural problems about the party leading legislative work in practice.
