"decision"),the nation,the whole country,set off a upsurge of implementing the "decision".Legal experts and scholars are actively researching and exploring the path of realization of governing the country according to law,the party and government departments at various levels also rushed to issue various documents,all walks of life are followed by making all kinds of measures.All kinds of innovation of creating patterns emerge in endlessly,they all want to carry out the management strategy in accordance with the law in various fields,the rule of law established in the national macroscopic framework,through all kinds of carrier to reflect people's will and the law of social development laws and regulations to manage all aspects of politics,economy and society,promoting regional democratic rule of law.So the rule of law to create activities are across the country,the main carriers of the activity are rule of city,county(district)under the rule of law,the rule of law township(town,street),democracy and rule of law demonstration village(community),the rule of law schools,the rule of law business,etc.Practice has made remarkable achievements.The whole society respects for law,advocating the atmosphere,the department of party and government administration,administration according to law in accordance with the specification,the law enforcement fair law enforcement specification,everyone abide by the constitution,the law is supreme,abide by the "statutory duties must be,without authorization for" the creed.The civil consciousness awakened,the research method,usage,the law has become a new fashion.But how to find out develop and use effectively to promote the progress of rule of law in the middle of the create activity,there are few research and practice.Especially in the rural areas,how to implement the "decision" through effective carrie has become a big problem in the test of the township party and government.whether prefecture county cure,fit all over the world.The villages and towns is the most broad management field of the country,the township government is also country's most basic regime organization.There are more than 2000 counties,41600 villages and towns,more than 900 million rural population in China.If people are rich,the country will be rich.If ordinary people are safe,the whole country will be security.Rural area is the cornerstone.The development and stability of the rural area is related to the long-term prosperity of the motherland.The development of the rural is unbalanced,the economy is backward,the quality of citizens is low,public service facilities are old,social contradictions and disputes are more and difficult to deal with,the construction of the rule of law is weak,and so on.All of the peoblems are to be studied the solution by law system in the governance of rule.Many experts and scholars has carried on the investigation and study on how to carry out the rule of law construction in small towns,the situation,existing problems,cause analysis and solution of the villages and towns of the rule of law construction.For example,Yuan Dayi,Li Yuan,Liu Li,Liu Xin,Huang Taiyun,Mao Yuyong who are judicial workers,lawmakers and law professor who are engaged in legal affairs.They have put forward their own good points of views about promoting the construction of villages and towns of the rule of law effectively.But how to find out the carrier,the base construction of rule of law construction is rarely touched from creation mode and practice.The innovation and highlight of this article is that,on the one hand above the draw on the views of experts and scholars together,this paper expounds in detail the construction of the rule of law,on the other hand,through the study of the theory of the article,to from a new view,that is,to create the new carrier of villages and towns under the rule of law to promote the construction of the rule of law,by creating new models "Guan Yinge",choose the new carrier,add new content,strengthen the practice,find the important and difficult points,from the goal of positioning to create Guan Yinge township under the rule of law,to the old,less,remote,mountainous,poor little towns in the construction of the rule of law were studied,and achieved good economic and social benefits.It is an operational replicable model of Guan Yinge of villages and towns to create rule of law which is promoted by Guan Yang county as a typical within the scope of the county.Therefore,this article studies on how to create a rule of villages and towns theoretically,in order to provide feasible countermeasures to solve the construction of the rule of law in the practice of bottleneck problem.This paper contains four parts.It states and demonstrates on the overview,present situation,problems,causes and countermeasures of village and township construction under the rule of law respectively.The first part of this paper focused on the overview of villages and towns,the concept of villages and towns under the rule of law,the content of the villages and towns under the rule of law;The second part expounds the present situation of the construction,the basic situation of the villages and towns construction the standards for the construction of villages and towns under the rule of law of the Guan Yinge township under the rule of law.It emphasis on achievements and problems of village and township construction of the rule of law;The third part analyzes the causes of problems of Guan Yinge township under the rule of law.They are the unequal power and responsibility,lack of supervision of law enforcement,unsmooth law enforcement system and mechanism,etc.It expounds the the cause of the lack of legislation,the difficulty of operation and the qualitative difficulty in rural area;The fourth part is that this paper expounds the suggestions for the development of villages and towns of Guan Yinge.By standardizing the strategic decision of township government administration according to law and improving the township administrative and law enforcement,the suggestions for effectively promoting the development of the rural legal system in villages and towns,in order to achieve the promoting of the construction of the rule of law efficiently. |
