A Study On The Rule Of Law Of The List Of Power System Of Grass-roots Government

The power list system is an innovation of our country's system,which plays an important role in promoting the rule of law.Promoting the power list system in an all-round way plays an important role in deepening the reform in an all-round way.With the deepening of the system,the role of the power list system of grass-roots government is becoming increasingly prominent.If the system can't be implemented by the grass-roots government along the road of rule of law,then it will lose its value and can not play its due role.In this paper,the grass-roots government as the object of study,through four parts of the grass-roots government power list system of the rule of law research.Firstly,it defines the legal basis and the connotation of the rule of law of the list of government powers.Firstly,the jurisprudential basis of the list of government power is discussed.Through the study of the control theory and the limited government theory,the jurisprudential basis for the legalization of the list of government power is established.Then it discusses the connotation of the rule of law of the list of government powers and the significance and goal of the rule of law of the list of powers system.The second part examines the current legal issues of the power list system of the grass-roots government.This paper discusses the phenomena of lack of substantive functional considerations,false liquidation of powers,unclear limits of authority and serious formalization of lists in the establishment of the power list system of grass-roots government,and then makes a thorough analysis of the current situation of the power list system of grass-roots government,from the perspective of law,to analyze the deep legal problems behind these phenomena.Thirdly,this paper takes two cities in Zhejiang Province as the object of empirical research.Starting with the effect of power list system construction in Fuyang City and Ninghai County,this paper investigates the whole process of the establishment and operation of power list system of two grass-roots governments,evaluates the practical experience of power list system construction of grass-roots governments from individual cases,and excavates the useful experience existing therein,and analyses its popularization.Finally,we should construct a legal guarantee mechanism for the power list system of grass-roots government.This part starts from the formulation stage of the power list of the grass-roots government to guarantee the rule of law.Establish the principles and standards of power combing to adapt to the grass-roots government,and improve the audit mechanism of power combing.And the dynamic adjustment mechanism of power list,supervision and management mechanism and accountability system mechanism are guaranteed by the rule of law.
