Building a responsible government and improving the administrative accountability system are the important contents of China's administrative reform.In recent years,the theory and practice of administrative accountability in China have achieved rapid development.Moral responsibility is an important part of administrative accountability,and it is also a matter of great concern to the public.It is also a key indicator of the moral construction of government officials.Therefore,it is of great theoretical and practical significance to explore the moral accountability of government officials and to analyze the various elements of administrative accountability in depth.This article selects the official moral accountability as the research object,takes the moral responsibility legalization as the background,examines the two lines and discusses through the institutional text analysis and the accountability practice,in order to improve the research theory of the legalization of moral responsibility,and clarify the blind spots and difficulties of accountability according to law in the practice of official moral accountability,and do a good job of seamless integration of theory and reality.In the text structure,this article is divided into six parts.The introduction part elaborates the research background,research significance and research status at home and abroad.It points out that the administrative accountability and moral responsibility have been widely studied.However,the research on moral accountability in the academic circles is not deep enough and still remains in the stage of the legalization of moral responsibility,not fully combined with practice for analysis.The text is divided into four parts.The first part elaborates on the connotation of moral responsibility and the theoretical and practical basis.First of all,the concept ofmorality and law,moral responsibility and legal responsibility are compared and defined.Moral responsibility includes first-degree moral responsibility and second-degree moral responsibility.It points out that the moral responsibility of this article refers to second-degree moral responsibility and further clarifies moral accountability includes the pursuit of moral responsibility and statutory moral responsibility.Based on this,it clearly points out that the research object of this article is the official moral accountability;secondly,it summarizes the basic characteristics of moral responsibility,namely,extensiveness,limitedness,high-levelness,mandatory and self-discipline;Finally,the necessity of moral accountability is explained in terms of theory and reality.It is pointed out that social contract theory,role theory and responsibility ethics theory are the theoretical basis for moral accountability,and The construction of a responsible government in our country and the pursuit of government legitimacy put forward a realistic demand for moral accountability.The second part analyzes the institutional text of moral accountability.The legalization of moral responsibility is the premise of legal accountability.Therefore,it is necessary to study the institutional text to find out whether it is perfect and whether it can guide the practice well.First of all,it summarizes the institutional texts related to moral accountability,and generally grasps the existing institutional texts.It points out that the existing institutional texts are numerous in number and in a decentralized form,and that the content mainly focuses on the "conflict of interests" in professional ethics;There are problems with the existence of institutional texts,such as the fact that the content of the reprimand is empty and general,and the principle of imputation is not clear,which makes the accountability in practice unfounded and may lead to arbitrary accountability.The third part examines and analyzes the practice of moral accountability.The ideal state of official accountability is accountability according to law,that is,the official moral accountability should be based on clear legal terms to pursue statutory moral responsibilities.First,review the typical cases in practice,Grasp the general overview and characteristics of the practice of moral accountability and summarizing the four characteristics of the practice of moral accountability:beginning with social accountability,high-level moral accountability,accountability for results,and becoming a weapon of anti-corruption;Then pointed out the existence of "response"accountability and unclear basis for accountability in the practice of moral accountability,and that it is impossible to balance the political response with the reasonableness of accountability;Finally,it makes a comprehensive analysis of the institutional texts and accountability practices,and analyzes the correlation between the two.On the basis of the foregoing,the fourth part puts forward thinking on improving the moral accountability.First of all,through the form of unified legislation and decentralized legislation,it is ensured that the law of moral accountability can be ascertained.Because of the limitations of the moral legislation,it can only stipulate the officials' bottom line moral obligations and bottom line moral responsibilities,and cannot exhaust all the bottom line moral obligations and moral responsibilities.Therefore,it is proposed to introduce a fault-finding system centered on the principle of fault,and improve the mechanism of moral supervision and moral rewards and punishments on the basis of perfecting the mechanism of government information disclosure.Finally,through moral education and training,external control is internalized into the moral self-discipline of officials.The conclusion part emphasizes the necessity of the legalization of official moral responsibility.It also points out the limitation of the legalization of moral responsibility.It is reiterated that the moral accountability cannot rely solely on the law and it requires the combination of rule and morality.
