The Research On The Legal Responsibility Of School Bullying

In recent years,bullying has frequently occurred in primary and secondary schools,and the bullying among students has drawn attention from the public.Primary and secondary schools are the beginning stages of life,as well as the periods in which people rising the knowledge and form the view of mental.After being bullied at school,the victims will have several psychological problems.Bullying will make the victims suffer from an unsound personality.At present,there are no laws and regulations specifically designed to punish in-school bullying behavior in China.There are only two prescriptive documents issued to prevent and treat bullying in schools(the Notice on Conducting Special Treatment of Bullying in Schools and Guidelines for Preventing Bullyingand Violence among Primary and Secondary School Students).In the current situation that there is a gap in laws for school bullying and no legal system,it is particularly important to study the legal responsibility for school bullying.The study methods adopted in this article are literature method,case analysis method and comparative study method.This article is divided into five parts:Part One: Introduction.It mainly illustrates the reason,the purpose,the content of this study,points out the study thinking and study methods of this article,and clarifies the core concepts of legal responsibility of school bullying..Part Two: School Bullying Legal responsibility Overview.First,the connotation of schoo bullying is defined through comparing school bullying behavior and school violence.Second,the responsible parties and the categories of legal responsibility of school bullying are described according to the nature and characteristics of school bullying.Part Three: The Jurisprudential Basis and Realistic Basis of Legal responsibility of school Bullying.The legal basis of legal responsibility for bullying in schools is mainly reflected in two aspects: the imputability of the subject of bullying and the detrimental nature of bullying.The necessity of legal responsibility of school bullying and the current legal provisions on legal responsibility of school bullying are the realistic basis for defining legal responsibility of school bullying.Part Four: Analysis on the Real-life Predicament and Reasons of Legal Responsibility of School Bullying.The predicament faced by definition of legal responsibility for bullying in China is analyzed through case study.The reasons for the existence of predicament are discussed from the perspectives of subject cognition and legal system.Part Five: Improving the Countermeasures of Legal responsibility of School Bullying.When improving the countermeasures of the legal responsibility for bullying at schools,the principle of Equitable responsibility and Dual Protection must be followed,ideology and concepts must be updated,the legal system for bullying in schools must be improved,the legal responsibility of school bullying and legal responsibility forms must be clarified,supervision must be strengthened,and a good rule-by-law atmosphere must be created.
