| Urban management covers the management in terms of urban planning,construction and management in a broad sense.However,urban management is simply equated with urban administrative law enforcement in government work.In order to solve the problems of high frequency of urban administrative law enforcement and duplicate law enforcement that disturbs residents,the State Council has carried out pilot work on the exercise of relatively centralized administrative penalty right around the country,has integrated the penalties related to urban affairs and transferred to law-enforcing departments since 1996.This is the origin of the comprehensive administrative law enforcement of urban management.With the rapid development of urbanization in China,the comprehensive administrative law enforcement of urban management is also undergoing changes.Since 2008,the State Council fully handed over the responsibilities of comprehensive urban management to local governments,and local governments also gradually moved urban administrative law enforcement officials down to Sub-district.Since 2015,the administrative penalty rights in the field of urban and rural construction has been further consolidated,and the focus of law enforcement has more inclined towards the grassroots to ensure adequate first-line law enforcement manpower.The structural reform of the comprehensive administrative law enforcement of urban management in Yancheng began in 2001.The reform has experienced three phases:the exercise of relatively centralized administrative penalty right,the downward shift of the focus of urban administrative law enforcement,and the further integration of the comprehensive administrative law enforcement function,which constitutes the current institutional framework.The structural reform of the comprehensive administrative law enforcement in Yancheng is not only a necessary preparation for the establishment of a national civilized city,but also the only way to improve the level of urban management and construct Yancheng under the rule of law.At present,Yancheng municipal government implements working mechanism of the separation of administrative authorities and administrative penalty right in the fields of housing and urban and rural construction.The government at municipal and district levels also clarifies the scope of duties of the functional departments at all levels.The municipal comprehensive administrative law enforcement team is mainly responsible for supervising and guiding the work,and construct an efficient informatization inspection system based on the digital platform.District comprehensive administrative law enforcement team moves the focus of law enforcement down to Sub-district,implements the grid management,and put more law enforcement forces on the front line.All kinds of reform measures are centered on how to solve problems for the people around them more easily and efficiently.Reform should give the people a sense of gains.The propaganda work is somewhat lagging,and the masses do not fully understand the structural reform of the comprehensive administrative law enforcement of urban management.However,according to a questionnaire survey of Yancheng citizens,it can be seen that the results of the reform is accepted by the public generally."Foreign stones may serve to polish domestic jade".Yancheng needs to learn advanced experience from typical cities.For example,the reform of the"Wide-ranging Urban Management" law enforcement system in Nanjing,the reform of the "Joint Operations" law enforcement mechanism in Shanghai,and the"Comprehensive City Administration" community governance system in Longgang District,Shenzhen.These advanced experiences bring such enlightenments to Yancheng's reform work as follows.There must be a high-level coordination mechanism to coordinate cooperation of planning,construction,and management among various departments.Further concentration of administrative penalty right can not be changed only partially.The focus of law enforcement must be truly down to the grassroots.It is not allowed to just transfer the matter to the grassroots,but the personnel are left at the higher authorities.To build an informatization platform to break the information isolated island in the field of urban management,and strengthen the information exchange between each link in planning,construction,management,and comprehensive administrative law enforcement.Compared with advanced experience,The system of the comprehensive administrative law enforcement of urban management in Yancheng has shown inadequacies.First,the legal protection is not in place.Whether it is legislative guarantee or judicial safeguard,it is disconnected with comprehensive administrative law enforcement.Second,the system of the comprehensive administrative law enforcement of urban management is not perfect,and there are practical problems such as lack of high-level coordination mechanism,serious shortage of grassroots manpower,and the confusion of double management system.Third,the lack of the sharing and linkage mechanism of information resources between various functional departments of planning,construction,and management and comprehensive administrative law enforcement agencies.Yancheng municipal government should pay sufficient attention to the structural reform of the comprehensive administrative law enforcement of urban management.It is suggested that the following reforms should be done in the following areas.First,rationalize the comprehensive law enforcement system,establish a high-level coordination mechanism,and revitalize idle personnel to the front line of law enforcement.We must also clarify the specific responsibilities of dual management.Second,improve the sharing and linkage mechanism of information resources between various functional departments of planning,construction,and management and comprehensive administrative law enforcement agencies.Finally,improve the government appraisal system,increase the propaganda,introduce public participation,and build a diversified supervision network. |
