The Study On Public Participation In Local Government Legislation

Public participation in government legislation can guarantee the consultative democracy,promote democratic politics,and form the joint development,co-governance and sharing of social governance.The public participates in politics and participates in social governance in accordance with the law,and cultivates a social mentality which is positive,rational,peaceful,full of self-respect and self-confidence.Grassroots organizations participate in social governance,highlighting the benign interaction between social autonomy and governance.This paper defines the connotation and characteristics of public participation in government legislation through the definition of public participation and government legislation.Public participation in government legislation is based on the theory of people's sovereignty,deliberative democracy theory and power restriction theory.With the development of civil society and the main status of administrative counterpart,public participation in local government legislation has made great progress in legislation and practice.According to the analysis of the actual samples,discovering problems which exist in the public participation in local government legislation,such as weak consciousness of public participation,non-standard program of public participation,insufficient for local government legislation information disclosure and lack of feedback mechanism,combined with the practice of the United States and the Japanese public participation in government legislation experience and enlightenment,put forward the improvement of public participation in government legislation path: by cultivating rational participation and incentive mechanism,to improve the public participation;to broaden the participation ways,to expand the participation subject,to realize the diversification of public participation mode;to establish a public system for the annual planning announcement system and draft regulations,to hold symposiums,hearings and discussion meetings in public to ensure the openness of the local government's legislative information;the public feedback mechanism should be established to improve the feedback mechanism of public participation.
