Research On Local Legislative Path Driven By Public Appeal

The Eighteenth and Nineteenth National Congresses of the CPC clearly put forward that we should speed up scientific and democratic legislation and promote the modernization of national governance system and governance capacity.The core of democratic and scientific legislation is to fully listen to the public opinion and absorb the wisdom of the people in the process of legislation.From the perspective of public governance,legislation should be an important means and tool of national and local governance.Therefore,legislation should adhere to the diversity and diversity of participants.However,in the current process of national and local legislation,due to the priority consideration of "government authority" and "law enforcement efficiency",relevant governments aoften adhere to the traditional concept of "control",from the proposal of legislative projects to the amendment and improvement of legislative projects,and then to the whole process and the whole process of the implementation of legislative projects,often forcibly joins the "demand for sectoral interests",adds civic obligations,and impairs civil rights,which makes this "top-down" legislative model difficult to be recognized by the public.Therefore,from the perspective of local legislation,this paper takes the public's legislative appeal as the research object,and perfects the path of Ningbo's public legislative appeal-driven legislation.This paper is divided into five parts: The first part studies the background and theoretical basis of public appeal-driven legislation,and expounds the relevant theories of democratic legislation,scientific legislation,public governance,public goods and so on.The second part defines the relevant concepts of public demand driven legislation.This paper expounds the specific content and existing advantages of public legislative demands,and combs and summarizes the foreign practices and beneficial enlightenments.The third part,taking the whole legislative process of Ningbo Civilized Behavior Promotion Regulation as an example,analyses Ningbo's public appeal-driven legislative practice.The fourth part analyses the problems and reasons of public legislative appeal in the process of expression,suggestion and game in the legislative process of Ningbo Civilized Behavior Promotion Regulation.The fifth part,based on the current legislative system and mechanism,combined with the actual situation of Ningbo,puts forward opinions and suggestions on improving the path of public appeal-driven legislation in Ningbo by applying the relevant theories of public governance and democratic legislation.
