Study On The Related Legal Issues Of The Operation Of Special Car

In recent years,with the rapid development of sharing economy and Internet economy,the special car has entered into people's lives quickly and shown explosive growth.At the same time,the supervision of taxi market and government department associated with the special car has ensued many problems,and the argument whether the special car should be legalized has been spread gradually in the whole society.Therefore,from the perspective of economic law,this article makes an initial analysis on the related legal issues of the operation of special car,which argues that the basic idea of economic law shall be established,so that the problems of special car can be solved by the principle of balance and coordination,fair competition and the unity of responsibility and right of economic law.On this basis,this paper puts forward the idea of solving the problems of special car.First of all,it recognizes and distinguishes the market of urban passenger transport again,and subject to the fix of the course,it divides the urban passenger transport market into the fixed line and non-fixed line.Furthermore,it gives an overall consideration to the problems of taxi and special car,and then regulates,optimizes and adjusts the non-fixed line market of urban passenger transport.At the same time,through the reform of the current taxi industry,the economic contracts are used to build the relationship between the government department and the Internet car-rental company.Besides,the measures of classification and management of the special car drivers are used to build the institutional framework of solving the problems of special car.Specifically,when retaining the current taxi industry,firstly we should carry on reform of the regulation system existing in the taxi industry.Secondly,the government department should regulate and control the operation of special car by means of economic law,namely,the method of entering into economic contract with Internet car-rental companies.Thirdly,the distinction should be made between full-time car drivers and part-time car drivers in the operation of special car,and the corresponding classification management should be carried on.Finally,on the basis of differentiating the full-time and part-time drivers,we should achieve the consultation of the government department and the Internet car-rental companies.Through signing the economic contract,the qualification and conditions of full-time car drivers and part-time car drivers should be regulated and identified,which should be executed by the Internet car company,supervised and managed by the government department.This paper consists of four chapters.The main contents are:The first chapter is introduction,which makes a brief discussion about the background and significance of the topic,the focus,methods as well as the innovation of this study.The second chapter is about the basic problems of the operation of special car,which expounds the concept and characteristics of special car.On this basis,it discusses the positive and negative impacts of special car on economic and social development since its emergence.The third chapter analyzes the legal issues of the operation of special car.Firstly,it focuses on the management problems in the market of urban operating vehicles,and makes a brief analysis of the resulting law of market control.Secondly,it introduces the contradictions and disputes between the special car and taxi,and on this basis makes a brief analysis of the contradictions from the perspective of the competition law.Finally,centering on special car companies,special car drivers and special car consumers,it discusses the legal relationships among the three subjects from the perspective of contract law briefly.The fourth chapter belongs to the part of countermeasures,which further solves the problems of special car operation based on economic law.It introduces and makes an analysis of the advantages and disadvantages of the approaches,administrative law and civil law,which are used to solve the proposed problems of the special car.On the basis of this,it analyzes the longitudinal economic relationships and lateral economic relationship in the special car operation from the perspective of economic law,and then puts forward the basic guiding theory,basic principles and basic frame conception to solve the problems of special car.
