Legislation Of Disability Welfare Research In China

China has a very large group of people with disabilities,and their welfare protection is not only a social problem,but also legal issues that countries cannot evade.With the development of society,the damage to the social rights of the disabled welfare is also increasing,which means legal safeguards to the disability benefits are particularly important.Legal protection of rights and interests of the welfare of the disabled is not only a measure of a country's economic and social level,but also an expression of competence and harmony.Only the welfare of the disabled is guaranteed,can the society truly become civilized and harmonious.This thesis proposes some suggestions for the legislation of the welfare of persons with disabilities on the premise of understanding the current development status,combined with China's actual situation and advanced foreign experience.The structure of the whole thesis can be divided into the following five parts:The first chapter analyzes the theoretical basis of disability benefits legislation,and combed the ancient Chinese thoughts about social welfare of persons with disabilities,elaborating from the concept of protection of human rights,justice and equity theory,the concept of democracy and the rule of law respectively.The second chapter illustrates the disabled welfare legislation historical vicissitude process of China.First,the thought of Chinese disability beneficial legislation shifts from the social relief to social welfare security.Second,the legal system of welfare for the disabled develops from the dual structure to combination.Again,the disabled welfare legal system appears that welfare comprehensive legislation combines with special legislative.The third chapter presents the characteristics of the disabled welfare legislation in the United States,Germany and Japan,from the aspects of medical rehabilitation,education,employment and barrier-free environment in the United States,the welfare benefits,employment and social service in Germany and medical rehabilitation,education and employment in Japan respectively.The fourth chapter puts forward countermeasures and suggestions to consummate the disabled welfare legal system of China.The author thinks that the government should set rights standard,accelerate the process of social welfare legislation,strengthen the participation of disabled persons,perfect the law enforcement mechanism and clear the responsibility to perfect our legal system of welfare for the disabled.The last chapter analyzes the present situation and existing problems of disabled person welfare legislation of China.The reasons for the slowly development of disabled welfare legislation in China are that: first,the disabled welfare legislation system in our country is not complete;second,the existing legal system of protection for all kinds of benefits for the disabled is unfair;third,the principle of ensuring the disabled welfare with state responsibility has not been reflected.
