The principle of fairness is one of the basic principles of civil law.When civil subjects engage in civil activities,they should follow the principle of fairness and reasonably determine the rights and obligations of all parties.In consumer rights and interests,the right to fair trade should run through the whole process of the transaction,the right to fair trade should be the basis and protection of other rights,if the buyer and seller lose fairness,other rights can not be realized.Because of the virtual nature and complexity of the network environment,the traditional offline transactions are different from the online transactions,so the consumers' fair trading rights are more vulnerable to infringement in online shopping transactions.Therefore,it is very important to establish a fair trading environment on the network.Under the socialist market economy system,the steady development of online consumption under the platform of C2 C promotes the development of social economy,provides consumers with more diversified goods or services,and makes the choice of goods and services more rapid and convenient.However,as the market supervision mechanism and laws and regulations in our country are not perfect enough,the operators,driven by their interests,have done a lot of infringing on consumers' right to fair trade.The number of purchases and the actual quantity is not in line with the phenomenon of frequent occurrence.Both operators and consumers belong to the main body in consumption,but in the whole process,consumers are in a weak position and need the protection of law.This article is divided into five chapters altogether.The first chapter is the introduction,mainly introduces the research background,the research purpose and the significance as well as the literature review.The second chapter mainly introduces the constitution of the right of fair trade of online shopping consumers in C2 C platform.It includes the subject,object and content of the right to fair trade.The third chapter mainly introduces the value structure of the right of fair trade of online shopping consumers in C2 C platform.The right to fair trading of consumers online is conducive to the realization of equal transactions between buyers and sellers,the protection of consumers' personal security,property and personal privacy,the protection of the weak,the improvement of economic efficiency,and the protection of the dignity ofparticipants in various transactions.The ultimate realization of social harmony.The fourth chapter mainly introduces the status quo and relief status of the fair trade right of online shopping consumers in C2 C platform.First of all,it introduces the relevant laws and regulations on the protection of the right to fair trade for consumers of online shopping in China,and points out the shortcomings of the existing laws and regulations;secondly,it analyzes the information asymmetry,fraud and overlord clauses in the process of exercising this right.The reason of a series of practical problems,such as low entry threshold,is summarized.The fifth chapter mainly introduces the ways to realize the right to fair trade of consumers in C2 C platform,and puts forward some suggestions on how to protect the right of fair trade for consumers.It specifically puts forward a series of suggestions,such as clarifying rights and obligations,attributing responsibilities,governing the courts,perfecting the operation mechanism and credit evaluation of the C2 C platform,establishing a consumer association for online shopping and specialized agencies dealing with online shopping disputes,and so on.In order to protect the right of fair trade of consumers in C2 C platform,the purpose of maintaining the healthy,stable and sustainable operation of network trading market can be realized.
