The 21st century is the era of information technology.The e-commerce industry has begun to develop at a rapid pace,and online shopping has become popular.In the face of an increasingly large number of online consumer groups and increasingly complex online shopping markets,various legal disputes cannot be effectively resolved.The gaps and defects in the protection of online shopping consumer rights in China are increasingly evident.This paper starts with the discovery of the existing problems of consumer protection of online shopping in China.Through theoretical research,legislative practice research and comparative research,the concept and structure of the online shopping consumer rights system and the legislative status of China's online shopping consumer rights protection are discussed.The foreign consumer protection system for online shopping is analyzed,and on the basis of theoretical and practical argumentation,it explores how to improve the relevant legislation and institutional arrangements.The internal theoretical system of online shopping consumer rights including the concept and nature of traditional consumer rights,the meaning and characteristics of online shopping consumer rights,the types of online shopping consumer rights,and the protection of online shopping consumer rights The significance.Theory is the basis for guiding practice.From the perspective of legal theory,the theoretical content that elaborates the basic logic is interlinked in any social form and can serve as an important reference and basic criterion for practical behavior.This paper investigates the current situation of the protection of consumers' rights and interests in online shopping in China,and finds that the current problems include the infringement of consumer's right to know,the lack of protection of fair trading rights,the threat of transaction security rights,and the difficulty of making claims for remedy.The reasons for the in-depth analysis of the above problems combined with the current legal system in China are mainly due to the imperfect legislation,the lack of establishment of network operators and commodity information audit systems,the incompleteness of the transaction supervision system,and the lack of effective online shopping dispute resolution mechanisms.Singapore,Japan,the United States and the European Union are more developed in e-comerce industry and the network shopping,they has accumulated rich experience in the field of network shopping consumer rights protection,not only through a lot of relevant legislation to establish the perfect legal system of online shopping,and implemented a series of specific measures,established the specialized network shopping consumer protection agency.Reference to such experiences in developed countries or regions can provide enlightenment for our country's system construction.Based on summing up China's current situation and foreign experience,we should proposes perfect countermeasures for the reasons for the existing problems of China's online shopping consumer rights and interests,including the improvement of online shopping-related legislation and the implementation of an information review system for network operators and their products.Improve the online shopping transaction supervision mode and establish authoritative and efficient dispute resolution mechanisms.This period can expand and improve the existing consumer rights protection system,introduce special legislation for consumer protection of online shopping,and respond to various infringements of consumer rights in online shopping by establishing multiple rights protection mechanisms and relief channels.Phenomenon,so as to build a systematic online shopping consumer rights protection system,and promote the healthy development of online shopping industry.
